Non -Compliance <br />CHS will document, in writing and in a timely manner, any discrepancies that <br />will require action by the Prime Contractor and/or subcontractors. Any <br />deficiencies in wage compliance shall also be brought to the immediate <br />attention of the Client. <br />The Prime Contractor will be given an opportunity to address outstanding <br />issues and/or make any wage restitution. The Prime Contractor or sub- <br />contractor may provide additional supplemental payroll records to indicate <br />that the proper payments of prevailing wages have been made. If payroll <br />clarification/corrections are not received from the Prime Contractor, we will <br />calculate and recommend to the Client the amount of wages owed to <br />workers that may withhold from the Prime Contractor's payment/ retention. <br />Upon receipt of any written or verbal complaints about underpayment from <br />workers, we will send a written acknowledgement to the complaining party <br />that the complaint was received. Also, we will provide a notice to the Prime <br />Contractor concerning the receipt of a complaint(s). <br />If necessary, our experienced team will begin an investigation of a complaint <br />of underpayment. Such an investigation will always be conducted in a fair <br />and professional manner and will include: <br />❑ A review of preconstruction meeting minutes. <br />❑ A review of all payroll records including time cards signed by each <br />worker. <br />❑ A review of the daily work logs maintained by the project's supervisor. <br />❑ One-on-one private interviews with workers that claim to have been <br />underpaid. <br />❑ Telephone interviews with workers that claim to have been underpaid. <br />❑ Preparation of written statements signed by workers indicating the <br />condition of their employment, the amount of underpayment, and/or <br />other violations. <br />❑ Preparation of narrative summaries of facts/discrepancies as well as <br />a complete calculation of the total underoavments. <br />17 <br />
