After a thorough examination, CHS will identify any underpayments of wage <br />rates by preparing an audit spreadsheet to document the affected employee <br />by name, trade classification, number of hours worked, rate paid, the correct <br />prevailing wage rate, the amount of underpayment, the periods that the <br />underpayment occurred. Furthermore, we will prepare a report that will <br />contain a statement regarding the intent of the underpayment; indicating <br />whether it was willful, a mistake and/or inadvertent. <br />CHS will assist the Client with any coordination with appropriate Federal <br />agencies such as HUD and/or the Department of Labor concerning audits <br />and/or hearings. <br />Section 3 Compliance <br />When required, CHS shall receive and process documentation demonstrating <br />the Prime Contractor(s) and subcontractor(s) best efforts to comply with <br />the Client's Section 3 hiring requirements and ensure that qualified Section <br />3 residents are hired and/or Section 3 businesses are contracted with. Such <br />Section 3 monitoring services include: <br />a. Documenting each contractor's intent and efforts to comply with <br />Section 3 hiring requirements and goals. <br />b. Reviewing the Workforce Projections of the contractors. <br />C. Receiving and reviewing a list of the employees of each <br />contractor, noting new hires. <br />e. Receiving proof of public notices in English and Spanish <br />announcing resident employment opportunities at the project <br />job site. <br />Also, CHS shall collect and document the Prime Contractor's and the <br />subcontractor's efforts to identify contracting opportunities to facilitate <br />participation by eligible Section 3 businesses. We shall collect and <br />document efforts to contact local agencies to assist in recruiting Section 3 <br />business enterprises and shall collect and document the contractor's efforts <br />to post public notices announcing business contracting opportunities at the <br />jobsite and in newspapers of general circulation. <br />CHS shall collect the Section 3 hiring reports that will cumulatively report <br />each Section 3 employee's name, employer, date hired, employee address, <br />family size, annual income, Section 3 status and hours worked on the <br />18 <br />
