cvn-out period is ninety (90) clays following the end of the Plan Year. <br />In the event that prescription drug coverage is offered under the Plan and to the extent that <br />the Plan Is an ERISA employee welfare benefit plan, Plan Sponsor shall be solely responsible for <br />determining whether the prescription drug coverage is creditable or non -creditable coverage for <br />Medicare Part D purposes, on either a stand-alone basis or in conjunction with another group <br />health plan. In such event, Plan Sponsor shall also be responsible for providing disclosure notices <br />to Medicare Part D eligible individuals who are covered under or apply for coverage under the <br />Plan advising whether the prescription drug coverage provided through the Plan, either on a stand- <br />alone basis or combined with another group health plan, is creditable. <br />20. TASC COBRA -NOT APPLICABLE <br />TASC and the Plan Sponsor agree to the terms that are described in the TASC COBRA <br />Client Administration Manual (or the COBRA Client Administration Manual -state continuation <br />if the Client is retaining TASC COBRA for state continuation), and accept the responsibility to <br />perform the functions that are listed on the Services and Responsibilities checklist. These Forms <br />are incorporated by reference. <br />TASC will provide appropriate notices to participants in a format and manner that is <br />consistent with federal or state law and regulations pertaining to continuation. TASC will be <br />entitled to assume that all the covered persons reside at the address of the employee provided by <br />the Plan Sponsor, unless the Plan Sponsor provides alternative addresses. TASC will monitor the <br />following cleadlines, election periods, premium payment grace periods, COBRA enrollment <br />requests, and Social Security extension requests. TASC does not have the discretion under this <br />Agreement to allow any exceptions to legally established deadlines, TASC will retain the 2% <br />administrative fee charged to participants for continuing coverage. <br />19 <br />
