later modified by the Plan Sponsor, including but not limited to: 1) Advise TASC of any changes <br />in employee population per location that may affect FMLA administration (increase or decrease <br />with relation to the minimum of 50 employees per covered location), 2) Advise TASC of any newly <br />acquired locations, in order to ensure compliance with FMLA administration, 3) Advise TASC of <br />any divested location (closing or stile to separate organization) that affects FMLA administration, <br />4) Provide TASC with current information regarding all benefit programs; provider's rates and <br />other pertinent information. TASC and the Plan Sponsor agree to the teens that are described in <br />the FMLA Client Administration Manual (including State Family and Medical leaves if subject), <br />and accept the responsibility to perform the functions that are listed in the above paragraph. <br />22. TASC ACA Employer Reporting -NOT APPLICABLE <br />ACA Reporting requires the Plan Sponsor to make initial and annual determinations, referred <br />to in the ACA Reporting Manual as "Determining Your Status under the ACA." TASC <br />recommends these ACA determinations made by the Plan Sponsor and reported to TASC be <br />reviewed by the Plan Sponsor's Benefits Advisor, Broker, or Benefits Counsel. The TASC Audit <br />Guarantee does not cover any 4980H penalties due to the failure to make accurate determinations. <br />TASC is not responsible for any 4980H penalties clue to activities that occurred, or the failure to <br />act, prior to the beginning of the Agreement with TASC. Complete information on the Group <br />Business Plan Application and complete monthly data must be provided to TASC prior to the <br />fifteenth day of December so TASC may meet federal timing limits. TASC is not responsible for <br />any late filing penalties if this data is provided after December 15 of each year. <br />23. TASC ERISA -NOT APPLICABLE <br />The Plan Sponsor agrees, as is necessary for the TASC to complete its responsibilities <br />herein, to timely provide the TASC with all applicable Plan and Benefit information to include <br />any insurance certificates, ASO certificates, plan summaries and the like needed for incorporation <br />in the Plan Document/Summary Plan Description.
