INSURANCE ON FILE <br /> UA'1�11r OCEED N-2026-131 <br /> UNTIL <br /> laIt19j�112 _---_ <br /> CITY CL ARK <br /> DATE: JUN 0 9 2026 <br /> LICENSE AGREEMENT <br /> U 11N%Tt ' <br /> tonttihn,\0 nuwJ(D21 This LICENSE AGREEMENT("Agreement")is dated as of May 1,2026,and entered into by and <br /> between the CITY OF SANTA ANA, a charter city and municipal corporation existing under the <br /> Constitution and laws of the State of California("City"),and Stanley D.Fear and Denise M.Fear,Trustees <br /> of the Fear Family Living Trust,dated August 27,2008 ("Licensees"). <br /> RECITALS <br /> A. Licensees are the owners of that certain real property located at 2144 North Mona Street <br /> ("2144 Mona"), described as Lot 182 of Tract No. 1724(APN 001-091-14). This property is bordered to <br /> the west by the parking lot of the River View Golf Course. <br /> B. City owns the land upon which the River View Golf Course parking lot is located. <br /> Beginning in 1964, the City leased the land to River View Golf corporation for the construction and <br /> operation of a public golf course. On November 21, 1966,the City granted Novel B.James,then owner of <br /> 2144 Alona, an "easement" to pass over the City's land for ingress and egress to and from the two-car <br /> garage on the property. The "easement" stated that it would terminate upon the termination of the City's <br /> lease with River View Golf for operation of the golf course. River View Golf and its successors operated <br /> the golf course until the end of the lease on April 30,2026. The"easement"has therefore terminated. <br /> C. Licensees continue to maintain a garage at 2144 Alona which is accessible for vehicle <br /> ingress and egress only by crossing over the River View Golf Course parking lot and therefore request a <br /> non-exclusive license to provide continued access to the garage. <br /> D. The proposed portion of area for access to Licensees' garage is depicted in the attached <br /> Exhibit 1(hereinafter"License Area"). <br /> E. City has determined that granting a non-exclusive license solely for the purpose of <br /> accessing the garage at 2144 Mona will not interfere with the operations of the golf course. <br /> F. Accordingly, City has agreed to grant a non-exclusive license to use the License Area, on <br /> the terms and conditions set forth in this Agreement. <br /> NOW THEREFORE, for and in consideration of the mutual covenants and agreements herein <br /> contained and for other good and valuable consideration, the receipt and sufficiency of which is hereby <br /> acknowledged,the parties hereto agree as follows: <br /> 1. License. The City hereby grants to Licensees a non-exclusive license for the right to enter <br /> and use the License Area beginning on May 1, 2026, upon the terms and conditions set forth herein <br /> ("License"), subject to Licensee's performance of all of its obligations under this Agreement. Licensees <br /> shall have the right to access the License Area via the "Ingress/Egress Limits" depicted in Exhibit 1. This <br /> License shall remain in effect for a period of 15 years and may be extended upon mutual written <br /> agreement of the Parties. The License may be terminated by City upon ninety (90) days written notice. <br /> This Agreement is intended and shall be construed only as a revocable license to use the License Area <br /> and not as a lease or grant of any possessory or other interest. <br /> 2. Permitted Use. Licensees are hereby granted non-exclusive right to use the License Area <br /> solely for the purpose of ingress and egress to and from their garage at 2144 Alona. Licensees shall not <br /> park or leave any motorized or non-motorized vehicles within the License Area at any time,with limited <br /> exceptions for accessing and opening gates, loading and unloading, and similar incidental activities. <br /> 1 <br />
