RESOLUTION NO.00-10 A RESOLUTION OF THE ZONING ADMINISTRATOR OF THE CITY OF SANTA ANA APPROVING CONDITIONAL USE PERMIT NO. 00-04 TO ALLOW A TYPE 41 ALCOHOL BEVERAGE CONTROL LICENSE FOR ON-PREMISES CONSUMPTION OF BEER AND WINE AT THE EL REY de MARISCOS RESTAURANT, LOCATED AT 501 NORTH HARBOR BOULEVARD, SUITE E WHEREAS, Conditional Use Permit No. 00-04 came before the Zoning Administrator for a public hearing on April 5, 2000, to allow a Type 41 Alcohol Beverage Control License for on- premises consumption of beer and wine at the El Rey de Mariscos Restaurant, located 501 North Harbor Boulevard, Suite E, Santa Ana; and WHEREAS, following said public hearing, the Zoning Administrator determined to approve Conditional Use Permit No. 00-04, subject to conditions. NOW, THEREFORE, BE IT RESOLVED BY THE ZONING ADMINISTRATOR OF THE CITY OF SANTA ANA AS FOLLOWS: 1. Based upon the evidence submitted at the abovesaid hearing the Zoning Administrator finds and determines as follows: A. Will the proposed use provide a service or facility, which will contribute to the general well being of the neighborhood or community? The sale of beer and wine for on-premise sale and consumption, as conditioned, will provide a service to restaurant patrons by providing the opportunity to select alcoholic beverages with the food service. B. Will the proposed use under the circumstances of the particular case be detrimental to the health, safety or general welfare of persons residing or working in the vicinity? The proposed Type 41, ABC license will not be detrimental to the surrounding businesses or residents since the service of alcoholic beverages is in conjunction with food service and must be consumed within the restaurant premise. The proposed conditions are designed to ensure the restaurant remains abona-fide eating establishment. C. Will the proposed use adversely affect the present economic stability or future economic development of property in the surrounding area? 1
