31 <br /> <br />ORDINANCE NO. NS-2421 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA REZONING PROPERTY GENERALLY <br />LOCATED IN THE AREA BETWEEN WALNUT STREET <br />AND WARNER AVENUE ALONG SOUTH MAIN STREET <br />FROM COMMUNITY COMMERCIAL (C-1) AND GENERAL <br />COMMERCIAL (C-2) TO A NEW ZONING DISTRICT <br />REFERRED TO AS COMMERCIAL SOUTH MAIN (C-SM) <br />(AA NO. 99-08) <br /> <br /> WHEREAS, Amendment Application No, 99-08 has been filed with the City of <br />Santa Aha to change the zoning district designation of certain real property generally <br />located in the area between Walnut Street and Warner Avenue along South Main Street, <br />in the City of Santa Ana, and more specifically delineated in Exhibit 1, attached hereto <br />and incorporated herein by reference, from Community Commercial (C-1) and General <br />Commercial (C-2) to Commercial South Main (C-SM), in the form set forth in Exhibit 2, <br />attached hereto and incorporated herein by reference, for said property as hereinafter set <br />forth; and <br /> <br /> WHEREAS, the Planning Commission of the City of Santa Ana held a duly noticed <br />public hearing on February 14, 2000, on Amendment Application No. 99-08 and based <br />thereon, determined that the development as proposed therein is consistent with the <br />General Plan of the City of Santa Ana, and recommended that the City Council approve <br />Amendment Application No, 99-08; and <br /> <br /> WHEREAS, this Council, prior to taking action on this ordinance, has held a duly <br />noticed public hearing, on Amendment Application No. 99-08. <br /> <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES <br />ORDAIN AS FOLLOWS: <br /> <br /> 1. The City Council has reviewed and considered the information contained in <br />the initial study and the negative declaration prepared with respect to this Ordinance. The <br />City Council has, as a result of its consideration, and the evidence presented at the <br />hearings on this matter, determined that, as required pursuant to the California <br />Environmental Quality Act ("CEQA") and the State CEQA Guidelines, a Negative <br />Declaration adequately addresses the expected environmental impacts of this Ordinance. <br />On the basis of this review, the City Council finds that there is no evidence from which it <br />can be fairly argued that the project will have a significant adverse effect on the <br />environment. The City Council hereby certifies and approves the negative declaration for <br />Environmental Review No. 99-168 and directs that the Notice of Determination be <br />prepared and filed with the County Clerk of the County of Orange in the manner required <br />by law. <br /> <br />Ordinance No, NS-2421 <br /> Page 1 of 3 <br /> <br /> <br />
