REQUEST FOR <br />COUNCIL ACTION <br />CITY COUNCIL MEETING DATE: <br />MAY 4, 2009 <br />TITLE: <br />AMENDMENT TO AGREEMENT WITH <br />CLEAR CHANNEL OUTDOOR INC. <br />FOR BUS SHELTER AND BUS BENCH <br />SERVICES <br />CITY <br />RECOMMENDED ACTION <br />CLERK OF COUNCIL USE ONLY: <br />APPROVED <br />^ As Recommended <br />^ As Amended <br />^ Ordinance on 1S` Reading <br />^ Ordinance on 2"d Reading <br />^ Implementing Resolution <br />^ Set Public Hearing For_ <br />CONTINUED TO <br />FILE NUMBER <br />Authorize the City Manager and Clerk of the Council to execute the <br />attached amendment to the agreement with Clear Channel Outdoor Inc., <br />subject to non-substantive changes approved by the City Manager and <br />City Attorney extending the agreement to provide and maintain bus stop <br />shelters and bus benches throughout the City. <br />DISCUSSION <br />The City currently has an agreement with Eller Media (subsequently re- <br />named to Clear Channel Outdoor Inc.) to provide bus shelter and benches <br />throughout the City. The agreement is due to expire in June 2010. <br />The City has approximately 145 bus shelters and 613 bus benches. The <br />bus shelters have advertising on one, two-sided panel at each location. <br />There is no advertising on the bus benches. These shelters and benches <br />provide bus patrons with shelter from the elements, a location visible <br />to the public, a safer environment from criminal activity at night and <br />a location for the disabled and elderly to rest while waiting for the <br />bus. <br />The total annual payment made to the City is currently $672,000. Under <br />the terms of the current agreement the City will receive one additional <br />payment in July. <br />Clear Channel has suffered severe cutbacks in their revenues due to the <br />downturn in the economy and has approached the City with an offer to <br />extend the current agreement for three years under the same terms, <br />25B-1 <br />
