RESOLUTION NO.00-10 <br />A RESOLUTION OF THE ZONING ADMINISTRATOR <br />OF THE CITY OF SANTA ANA APPROVING <br />CONDITIONAL USE PERMIT NO. 00-04 TO ALLOW <br />A TYPE 41 ALCOHOL BEVERAGE CONTROL <br />LICENSE FOR ON-PREMISES CONSUMPTION OF <br />BEER AND WINE AT THE EL REY de MARISCOS <br />RESTAURANT, LOCATED AT 501 NORTH HARBOR <br />BOULEVARD, SUITE E <br />WHEREAS, Conditional Use Permit No. 00-04 came before the Zoning Administrator for a <br />public hearing on April 5, 2000, to allow a Type 41 Alcohol Beverage Control License for on- <br />premises consumption of beer and wine at the El Rey de Mariscos Restaurant, located 501 North <br />Harbor Boulevard, Suite E, Santa Ana; and <br />WHEREAS, following said public hearing, the Zoning Administrator determined to <br />approve Conditional Use Permit No. 00-04, subject to conditions. <br />NOW, THEREFORE, BE IT RESOLVED BY THE ZONING ADMINISTRATOR OF <br />THE CITY OF SANTA ANA AS FOLLOWS: <br />1. Based upon the evidence submitted at the abovesaid hearing the Zoning Administrator <br />finds and determines as follows: <br />A. Will the proposed use provide a service or facility, which will contribute to the general <br />well being of the neighborhood or community? <br />The sale of beer and wine for on-premise sale and consumption, as conditioned, will <br />provide a service to restaurant patrons by providing the opportunity to select <br />alcoholic beverages with the food service. <br />B. Will the proposed use under the circumstances of the particular case be detrimental to the <br />health, safety or general welfare of persons residing or working in the vicinity? <br />The proposed Type 41, ABC license will not be detrimental to the surrounding <br />businesses or residents since the service of alcoholic beverages is in conjunction <br />with food service and must be consumed within the restaurant premise. The <br />proposed conditions are designed to ensure the restaurant remains abona-fide eating <br />establishment. <br />C. Will the proposed use adversely affect the present economic stability or future economic <br />development of property in the surrounding area? <br />1 <br />
