• bk:7/15/09 <br />RESOLUTION NO. 2009-07 <br />A RESOLUTION OF THE ZONING ADMINISTRATOR OF <br />THE CITY OF SANTA ANA ADOPTING MINOR <br />EXCEPTION NO. 2009-04 TO PERMIT A FIVE PARKING <br />SPACE MINOR EXCEPTION FOR THE PROPERTY <br />LOCATED AT 1626 EAST FOURTH STREET <br />BE IT RESOLVED BY THE ZONING ADMINISTRATOR OF THE CITY OF <br />SANTA ANA AS FOLLOWS: <br />Section 1. The Zoning Administrator of the City of Santa Ana hereby finds, <br />determines and declares as follows: <br />A. The applicant is requesting approval of a minor exception to allow the <br />development of an existing office building into its new headquarters. <br />Approximately three-fourths of the building (8,484 square feet) will be <br />utilized by The Cambodian Family, with the remaining area (2,212 square <br />feet) to be occupied by the existing office tenant. The applicant proposes <br />to convert the first floor into a child care center with a maximum enrollment <br />of 64 children split into two sessions and locate its offices on the second <br />• floor. An outdoor child play area is proposed that if constructed would <br />take up five existing parking spaces. <br />B. Under the Santa Ana Municipal Cade 31 parking spaces are required and <br />26 would be provided under the applicants plan. <br />C. Minor Exception No. 2009-04 came before the Zoning Administrator of the <br />City of Santa Ana for a public hearing on July 22, 2009. <br />D. Santa Ana Municipal Code Section 41-134 would bar the proposed <br />expansion unless 31 parking spaces could be provided. <br />E. Santa Ana Municipal Code Section 41-638.1 authorizes the Zoning <br />Administrator to grant a minor exception upon making certain findings. <br />1. That the granting of a minor exception to allow two or more <br />independent uses to share the required parking stalls will not result <br />in a conflict between parking for one use and parking for another due <br />to differences in time of primary utilization of parking. <br />The granting of the minor exception will not result in a conflict <br />between the parking for the different users on the site. A <br />parking study was prepared that shows that 27 parking <br />• spaces would accommodate all users; however, the loss of a <br />single additional parking space as approved in this resolution <br />is superior to the site plan with 27 parking spaces because it <br />Resolution Na. 2009-07 <br />Page 1 of 4 <br />
