CITY OF SANTA ANA <br />SPECIFICATIONS <br />PROJECT NO.: XX-XXXX <br /> PROJECT TITLE <br /> <br />13 <br />Upon approval by the Engineer, the Contractor’s QSD shall upload the Annual Report to <br />SMARTS. The AGENCY will certify and submit the Annual Report to the Regional Board. <br />Failure to submit the Annual Report as specified herein shall result in Liquidated Damages, as <br />outlined in the Bid Proposal. <br />Upon completion of a project and final stabilization of the construction site, the Contractor shall <br />submit a Notice of Termination (NOT), as outlined in the most current Constructi on General <br />Permit. The NOT shall be prepared by the Contractor’s QSD. The Contractor shall submit the <br />NOT to the AGENCY for approval by the Engineer. Upon approval by the Engineer, the <br />Contractor’s QSD shall upload the NOT to SMARTS. The AGENCY will certify and submit the <br />NOT to the Regional Board. The NOT shall be submitted to the AGENCY within 15 working <br />days of the Notice of Completion date. Failure to submit the NOT as specified herein shall <br />result in Liquidated Damages, as outlined in the Bid Proposal. <br />The Contractor shall be liable for all violations and fines levied against the AGENCY by <br />Federal, State or Local Agencies with regulatory authority as a result of the Contractor not <br />complying with the requirements of the most current Construction General Permit. <br />The Contractor shall notify the AGENCY of any activities, past, current, or present, that may be <br />considered non-compliant with the Construction General Permit within 1 working day of <br />becoming aware of said activity. <br />SECTION 4 - CONTROL OF MATERIALS <br />4-1 GENERAL <br />Should the Contractor fail to correct deficiencies or public nuisances that have been created <br />because of his/her operation, then these will be considered to be of an emergency nature, and will <br />call for the AGENCY to move in on the project to take corrective action. Such work will be <br />done on a force account basis with an additional callout charge. There is a minimum two-hour <br />charge for labor on any callout plus an additional callout charge of $300. <br />4-4 TESTING <br />Add the following to this subsection: <br />Material testing will be performed by the Orange County EMA Materials Laboratory or a private <br />laboratory engaged by the AGENCY for the construction of this project. <br />The AGENCY will bear the cost of testing material which meets the requirements indicated in <br />these General Provisions. The cost of retesting of material that fails to pass the first test shall be <br />borne by the Contractor. <br />505 E Central Ave <br />#B11/6/2024
