Closeout Submittals: Submit to owner documentation certifying compliance with the SWPPP, <br />site monitoring reports, and notification of Agencies of completion of operations as required by <br />the General Construction Permit. <br />D. Provide a Rain Event Action Plan (REAP) if project is considered a RISK LEVEL 2 or 3. <br />REAP shall be prepare by the project QSP. <br />E. SWPPP plan. <br />1. The SWPPP will be prepared by a Qualified SWPPP Developer (QSD) certified by the <br />RWQCB, as required by the General Construction Permit. <br />2. Implementation and report processing of the SWPPP shall be conducted by a Qualified <br />SWPPP Practitioner as required by the General Construction Permit. <br />3. <br />1.4 REGULATORY BACKGROUND <br />A. As required by Federal Water Pollution Control Act (Clean Water Act) and regulations of U.S. <br />Environmental Protection Agency and of State of California Water Resources Control Board <br />current General construction Permit, any construction activity of ONE acre or more must be <br />covered by National Pollutant Discharge Elimination System (NPDES) permit. <br />B. The Act further decrees fines of as much as $37,500 per day per violation. <br />C. It is implicit that SWPPP satisfies requirements of NPDES permit. <br />D. If Owner is cited for violation of Clean Water Act due to failure of SWPPP to address <br />requirement, Contractor shall be liable for any fines or penalties that might be imposed by <br />regulatory agency, he shall be obligated to perform mandated corrective measures at his own <br />expense. <br />E. If Owner, Architect, or Owner's Inspector becomes aware of violations of SWPPP, they will <br />immediately inform Contractor in writing. Contractor shall immediately cease violation and <br />shall restore site, at his own expense, to same conditions it was in before violation, to approval <br />of Owner. <br />F. Should Contractor continue to violate requirements of SWPPP, or refuse to comply, or refuse to <br />repair results of violation to Owner's approval, for purposes of this Contract it shall be <br />considered as any other violation of Contract. Owner will take necessary measures as set forth <br />in General Conditions.
