Carvalho <br />CLERK OF THE COUNCIL <br />Maria 0, Huizar <br />In accordance with the requirements of the Comprehensive Transportation Funding Programs (CTFP) <br />Guidelines and Master Funding Agreement No. C-1-2783, between Orange County Transportation Authority <br />(OCTA) and City of Santa Ana, the City of Santa Ana Public Works Agency is seeking concurrence that the <br />sale of excess right-of-way acquired with M2 program and OCTA Gas Tax funds from these programs must <br />be at fair market value and these proceeds must be paid back to the project funds as described in the executed <br />funding agreements. Additionally, all transactions are subject to audit, thereby local agencies must follow <br />established eligibility requirements, agreements and applicable laws regarding the use of public funds. <br />Chapter 10 of the CTFP Guidelines reads: <br />i°Agencies that use Net Revenues (through CTFP or Local Fair Share programs) to acquire <br />project right-of-way shell dispose of land deemed in excess of the proposed transportation use. <br />Excess land sold by the lead agency will be disposed of in accordance with the process <br />established in Government Code, Article 8, Surplus Land, Section 54220-54232, etc, Seq, and the <br />right-of-way acquisition/disposal plan submitted as part of the application process. The agency <br />shall return proceeds from the sale to OCTA. OCTA shall return the funds to the program of <br />origin for future use, Proceeds from the sale of excess right-of-way shall be returned to OCTA in <br />proportion to the amount of M2 finds used in the purchase," (10-9) <br />Thereby, in acknowledging obligations under aforementioned requirements, and in accordance with state <br />law, we respectfully request concurrence from OCTA that the sale of excess right-of-way parcels <br />acquired with M2 program and OCTA Gas Tax funds must be at fair market value and the proceeds of the <br />sale must be returned to the project, or returned to OCTA to be used for transportation purposes alone. <br />Thank you sincerely for your attention to this matter.
