Responsibility Timing <br />Monitor <br />(Signature <br />Required) <br />(Date of <br />Compliance) <br />must be prepared to fund <br />those areawide transportation <br />improvements which <br />principally benefit their project <br />as well as contribute a one <br />percent assessment to the TSIP <br />Program. <br />MM 5.6-2: Provide funding for <br />construction of a pair of new <br />freeway ramps on the west <br />side of Fashion Square linking <br />the Santa Ana Freeway with a <br />public road surrounding the <br />project. <br />These two new ramps will <br />connect with a public street <br />and as such, provide overall <br />benefit to the general public. <br />However, the primary need for <br />and beneficiary of this <br />improvement is the Fashion <br />Square development itself. The <br />cost of this improvement is <br />included in the overall TSIP <br />Plan, but that program is <br />underfunded by approximately <br />50 percent. Consequently, the <br />cost of any transportation <br />improvements which relate to <br />Not applicable: Final EIR Mitigation Measure <br />5.6-2 required the developer of the Mall to <br />“[p]rovide funding for the construction of a pair <br />of new freeway ramps on the west side of <br />Fashion Square linking the Santa Ana Freeway <br />with a public road surrounding the project” (the <br />future MainPlace Drive) but was determined to <br />be infeasible, and replaced with an obligation to <br />contribute to the cost of other ramps then <br />planned by Caltrans. This change was <br />documented in a 1992 amendment to the <br />Participation Agreement between the City’s <br />Redevelopment Agency and the Mall developer <br />(Third Amendment to Participation Agreement, <br />p. 2.), which explained: <br />“It has now been determined that the ramps <br />specified in the Participation Agreement cannot <br />be constructed, but that ramps providing <br />substantially similar value to the transportation <br />system are planned for construction....” <br />The alternative ramps identified in the amended <br />-- -- --
