Any modification or <br />amendment proposed by the Contractor must be submitted in writing to the City, and <br />may require feedback and concurrence from OCFA. Any agreed modifications and/ or <br />amendments must be in writing, approved by all parties. <br />4.2 CONTRACTOR SELECTION AND AWARD: <br />The award of contract under this RFP will be made by the City of Santa Ana. All <br />Proposers will be notified in writing at the conclusion of the procurement process as to <br />the results of the bid proposal evaluation process and the final award recommendation. <br />Proposers will receive mailed award/non-award notifications, which will include the <br />name of the Proposer awarded the contract. <br />A. Request for Council Action: <br />Following evaluation and rating by the proposal review committee, the Executive <br />Director will recommend award of an agreement to the Proposer providing the <br />best quality and value to the City. Any contract resulting from this RFP shall not <br />be effective unless and until approved by the City Council/City Manager, as <br />applicable. <br />B. Execution of Agreement: <br />A sample standard agreement is included as Attachment B: Professional <br />Service Agreement in this RFP. "Proposer" will hereinafter be referred to as <br />"Consultant" or "Contractor" in the standard agreement. The term of the <br />agreement will begin after the agreement is fully executed, and all required <br />bonds, insurance documents and contents of the payment information packet <br />have been received and approved. <br />4.3 AWARD PROTESTS: <br />Proposers may file a protest to a RFP with the City's Purchasing Division.
