Customers may lease from Contractor or third parties compaction equipment that may <br />be attached to Bins. The provision of compaction equipment is outside the scope of this <br />Agreement. Collection of Bins using these devices remains within the scope of this <br />Agreement unless otherwise excluded per Section 2.9. <br />4.3.2 Commercial Cart Service <br />As an alternative to the requirements of Section 4.3.1, Contractor shall offer Collection <br />in Refuse Carts to Customers at Multi -Family and Commercial Premises that do not <br />have space for, or do not generate enough waste to require the use of Bins for Collection <br />in accordance with the approved rate schedule. If Contractor and Customer have a <br />disagreement as to whether Cart service is appropriate, or if City determines that <br />Collection in Carts causes health and safety or other concerns, City shall make the final <br />determination as to whether Collection in Carts may occur. Multi -Family Premises with <br />a Homeowners' Association may request Cart service upon approval by the Executive <br />Director, and shall be charged the Residential Curbside Service Unit rates included in <br />the approved rate schedule. Commercial and Multi -Family Premises Customers that <br />receive Refuse Carts, shall also receive a Recycling Cart at no additional charge. <br />4.3.3 Roll -off Box Service <br />Contractor shall provide exclusive (as limited by Section 2.9) permanent and temporary <br />Roll -off Box Collection (excluding Temporary Construction and Demolition service) <br />service upon request. Contractor must deliver a temporary Roll -off Box to a Customer <br />within two business days (excluding Saturday, Sunday and holidays listed in Section <br />4.7.1) of request. Special request to empty Roll -off Boxes outside of regularly scheduled <br />Collections shall be performed within one business day. <br />Contractor will provide standard 10, 30 and 40-cubic-yard standard Roll -off Boxes. The <br />provision of compactor Roll -off Boxes, which are enclosed Containers attached to a <br />compaction devise, is not included in this Agreement. Providing service to such <br />compactor Roll -off Boxes is included. <br />Contractor shall transport and process Roll -off loads at a MRF in compliance with <br />CalRecycle and acceptable to the City. <br />hi the event that Contractor is unable to provide temporary service to any Customer <br />within five (5) business days (excluding Saturday, Sunday, or holidays listed in Section <br />March 9, 2020 41 City of Santa Ana - DRAFT <br />60A-130 <br />
