To avoid permanent indirect impacts to roosting and <br />foraging bats, the City Public Works Director or designee shall ensure that bridge lighting on the new <br />bridge is designed and installed in such a way that light overspill into the Santa Ana River and beneath <br />the bridge is limited to the greatest extent practicable. <br />City of Santa Ana Public <br />Works Director or <br />designee <br />During Project design <br />Mitigation Measure BIO-7: Resource Agency Permits. Prior to construction of the Project the City Public <br />Works Director or designee shall submit resource agency permit applications and obtain permits <br />authorizations from the United States Army Corps of Engineers (USACE) (Section 404 Nationwide Permit <br />authorization), CDFW (Section 1602 Streambed Alteration Agreement), and Regional Water Quality <br />Control Board (Section 401 Water Quality Certification). The City Public Works Director or designee shall <br />ensure compliance with all permit conditions. <br />City of Santa Ana Public <br />Works Director or <br />designee <br />Prior to construction <br />Mitigation Measure BIO-8: Best Management Practices (BMPs) during Construction. The Construction <br />Contractor shall ensure that all equipment maintenance, staging, dispensing of fuel or oil, or any other <br />such activities shall occur in designated upland areas. The designated upland areas shall be located in <br />such a manner as to prevent any spill runoff from entering Waters of the United States and other <br />jurisdictional waters. Silt fencing and straw wattle shall be placed in such a manner that they are able to <br />catch or filter sediment or other construction-related debris to prevent it from entering aquatic areas, <br />where necessary. All construction-related debris and trash shall be disposed of or secured to prevent any <br />such waste from entering aquatic areas. <br />Construction <br />Contractor <br />During construction <br />Mitigation Measure BIO-9: Invasive Species. In order to prevent the spread of invasive species <br />(Executive Order 13112), the Construction Contractor shall ensure that any plants removed or soil <br />disturbed during the course of construction are contained and properly disposed of offsite. All mulch, <br />topsoil, seed mixes, or other plantings used during landscaping activities and any erosion-control BMPs <br />implemented shall be free of invasive plant species seeds or propagules. No vegetation listed on the <br />California Invasive Plant Council (Cal-IPC) inventory shall be installed on the Project, and all plant palettes <br />proposed for the Project shall be reviewed by a qualified biologist during the Final Design phase. <br />Construction <br />Contractor <br />During construction
