The City Public Works Director or designee shall verify <br />that all construction plans specify the requirements of California Code of Regulations (CCR) Section <br />15064.5(e), State Health and Safety Code Section 7050.5, and Public Resources Code (PRC) Section <br />5097.98. <br /> <br />In the event that human remains are encountered in the Project area during construction activities, work <br />within 50 feet of the discovery shall be redirected and the County Coroner notified immediately <br />consistent with the requirements of CCR Section 15064.5(e). If the remains are determined to be Native <br />American, the County Coroner shall notify the Native American Heritage Commission (NAHC), which shall <br />determine and notify a Most Likely Descendant (MLD). With the permission of the landowner or his/her <br />authorized representative, the MLD may inspect the site of the discovery. The MLD shall complete the <br />inspection and make recommendations or preferences for treatment within 48 hours of being granted <br />access to the site. The MLD recommendations may include scientific removal and nondestructive <br />analysis of human remains and items associated with Native American burials, preservation of Native <br />American human remains and associated items in place, relinquishment of Native American human <br />remains and associated items to the descendants for treatment, or any other culturally appropriate <br />treatment. <br /> <br />Consistent with CCR Section 15064.5(d), if the remains are determined to be Native American and an <br />MLD is notified, the City of Santa Ana Public Works Director or designee shall consult with the MLD, as <br />identified by the NAHC, to develop an agreement for treatment and disposition of the remains. <br />City of Santa Ana Public <br />Works Director/ <br />Construction <br />Contractor <br />During initial ground <br />disturbing activities and <br />in the event that human <br />remains are uncovered <br />during the construction <br />period <br /> <br />3.6 ENERGY <br />There are no significant impacts to energy.
