DocuSign Envelope ID: 01 C1 DA1 D-6C6A-4608-A484-D928555169F0 <br />City of Santa Ana Public Works <br />OPC Water Resources Right of Way Acquisition Services PAGE 15 <br />be made to present the FWO in person (when <br />possible) within one week of the approved <br />appraisal with an outside window of no more <br />than 30 days. <br />Offers will be presented to all parties with <br />a compensable interest, including property <br />owners and occupants (tenants/lessees) <br />owning improvements pertaining to the realty. <br />If a meeting cannot be arranged, the acquisition <br />agentwill attemptto make telephone contact with <br />the property owner, prior to sending the FWO <br />package by mail (return receipt requested) and <br />follow up with calls (personal meetings, when <br />able, with social distancing). FWO packages <br />will include a summary appraisal statement or <br />full appraisal where required by law, and an <br />information pamphlet on eminent domain. The <br />appraisal report and all offer documents will <br />be explained in detail and reviewed with the <br />property owners and, if necessary, tenants with <br />a compensable interest. Agents will continue <br />their "good faith negotiations" and follow in - <br />person meetings, as necessary, with written <br />correspondence, counter-offer packages (if <br />any), purchase agreements, easements, grant <br />deeds and other documents necessary to <br />complete the acquisition. <br />The acquisition agent will respond to all <br />questions about the offer and process and will <br />maintain phone and/or personal contact with <br />owners to facilitate settlements. Our experience <br />has shown us that personal contacts increase <br />the likelihood of amicable settlements. Acquiring <br />RIGHT OF ENTRY (ROE) <br />property through negotiated settlements may <br />necessitate greater levels of effort and, where <br />appropriate, will continue even after pre - <br />condemnation proceedings have been initiated. <br />When a conditional settlement has been <br />reached that is subject to review and approval <br />by the PWA, the acquisition agent will provide <br />the PWA with a written report for consideration. <br />If an administrative settlement appears to be <br />prudent, reasonable and in the public interest, <br />the acquisition agent will prepare a settlement <br />discussion memorandum reviewing the issues <br />and providing support for any settlement beyond <br />the approved appraisal amount. <br />If a settlement with owners and other required <br />interests is reached pursuant to the PWA's <br />approved appraisal or an administrative <br />settlement, the acquisition agent will prepare <br />a Memorandum of Settlement (MOS). After <br />being checked for quality and consistency, the <br />MOS will be transmitted to the PWA within one <br />week of receiving the owner's signature on the <br />required documents. Conditions of title and <br />escrow instructions, including title exceptions, <br />will be reviewed and the disposition of each <br />exception will be addressed in the MOS and <br />escrow instructions to the title company. OPC <br />agents will coordinate escrow with the PWA's <br />preferred title company, including securing re - <br />conveyance and subordination agreements as <br />necessary, and obtain title insurance policies <br />after the close of escrow. OPC agents will <br />complete all final close-out work per the PWA's <br />requirements. <br />OPC will provide the needed Right of Entry (ROE) services. Ourfirm is highly -experience <br />in this scope of work and we have obtained hundreds of ROE for OPC's projects. OPC will <br />confirm the number of separate Right of Entry permits required for the PWA's assignment. <br />The following outlines briefly the scope of work expected in obtaining ROE permits: <br />1. Draft Right of Entry (ROE) documents and secure approval as to form from the PWA. <br />2. Establish personal contact with property owners, wherever possible; present details of ROE. <br />3. Negotiate with property owners and secure execution of required agreements. <br />4. Provide regular status updates to any relevant parties associated with the Project Team. <br />5. Facilitation of any payments from the PWA to private property owners, via mail. <br />6.
