affected Tenant/Resident households in an amount equal to three (3) times the current <br />Fair Market Rent for a similar Rental Unit in Orange County as determined by the U.S. <br />Department of Housing and Urban Development. Tenant/Resident households with at <br />least one Qualified Tenant shall be entitled to an additional payment equal to one (1) <br />times the current Fair Market Rent for a similar Rental Unit/Dwelling as determined by <br />HUD as part of their Relocation Assistance. To the extent permitted by law, the <br />Relocation Assistance required herein shall be a minimum amount. Relocation assistance <br />amounts should reflect the true costs paid by Tenant/Resident households to leave a <br />home, including the costs to take time off of work or school to pack up belongings and <br />move, and the costs associated with finding a new home, including, but not limited to, a <br />new security deposit and first and last month's rent. The best way to determine the <br />appropriate relocation amounts is to conduct a study of the housing market. The City <br />should adopt the relocation amounts implemented by the City of Los Angeles, a <br />bordering jurisdiction, until it can conduct a housing study that supports higher relocation <br />amounts for the City of Santa Ana. The Board may increase the amounts of Relocation <br />Assistance pursuant to its powers under law. The Landlord shall also waive the affected <br />Tenant's/Resident's payment for the final month of rent, in an amount equal to at least <br />three months' worth amount of rent. <br />(2) The Landlord shall notify the affected Tenants of their rights under this subsection, if <br />any, at the time of the service of any notice terminating the tenancy. The Relocation <br />Assistance shall be paid to Tenant households who vacate a Covered Rental Unit or <br />Rental Unit/Dwelling within the earlier of 15 calendar days of the notice from (2), or no <br />later than the time that they vacate the Covered Rental Unit or Rental Unit/Dwelling. <br />(3) The Board shall issue rules and regulations to effectuate this subsection including but <br />not limited to the procedures for establishing and facilitating payment of the Relocation <br />Assistance, including rules for determining whether a Tenant meets the criteria for a <br />Qualified Tenant, and rules to ensure the reasonably timely payment of any applicable <br />Relocation Assistance. <br />I. Posting of Notice. For every Property containing Covered Rental Units subject to this Chapter, <br />the Landlord shall post a notice on a form prepared and authorized by the Rent Board, providing <br />information about the existence of this Chapter. Notice must be posted in a conspicuous location <br />in the lobby of the Property, near a mailbox used by all Tenants, or in or near a public entrance to <br />the Property. The notice shall be written in English, Spanish, Chinese, Tagalog, Vietnamese and <br />Korean, and in any other languages as required by the Rent Board. <br />J. Retaliation is Barred. No Landlord may threaten to bring, or bring an action to recover <br />possession, cause the Tenant to quit the unit involuntarily, serve any Written Notice to Cease or <br />notice of termination of tenancy, decrease any services or increase the Rent where the Landlord's <br />48 <br />
