Minor Exception No. 2021-02 – Chilly Willy Desserts Front Yard Fence <br />October 20, 2021 <br />Page 2 <br />1 <br />8 <br />7 <br />1 <br />DISCUSSION <br />Project Description <br />The subject property is a 0.21-acre corner lot developed with a two-story industrial <br />warehouse building and a parking. The applicant is proposing to install a seven-foot high <br />decorative wrought iron fence within the front yard setback. The fence will be constructed <br />along both street frontages, Fourth Street and Eastwood Avenue, and will have two access <br />gates along Eastwood Avenue. The site is serviced with three existing driveway approaches, <br />however, the driveway apron along Fourth Street will not be used since the proposed fencing <br />will not allow vehicular access from that street. Of the two access gates along Eastwood <br />Avenue, the one located furthest north will be operated manually and the other will be an <br />automatic gate. The wrought iron fence is designed with 1-inch-by-1-inch vertical rails with <br />2-inch square posts at the end of each panel. The site design provides a number of planters <br />along both street frontages. Staff has conditioned the approval to require the applicant to <br />rehabilitate the existing landscape planters as we (Exhibit 1). <br />Staff is recommending approval of the request due to recent break-ins and defacing of <br />property. However, after consulting with the Public Works Agency regarding the trash <br />vehicle pick-up, staff is recommending modifications to the proposed fencing plan. As a <br />revision to the plan, the wrought iron fence along the Fourth Street perimeter will need to be <br />moved away from the street, closer to the building, in order to provide vehicle access to <br />the parking lot and access to the trash enclosure for service. Closing the driveway access <br />from Fourth Street would prohibit adequate trash truck access and service. Additionally, <br />the driveway apron would need to be removed in its entirety and replaced with a new <br />curb, gutter, and sidewalk per City Standards. <br />Finally, staff is also recommending that the third vehicle gate, located at the northernmost <br />portion of the property be replaced with a fixed seven-foot fence and the existing <br />landscape planter to be extended towards the north property line. This will eliminate an <br />excess driveway approach, while also increasing the amount of landscaping on-site, <br />ultimately softening the height of the fence. <br />Project Background <br />The site was developed in 1946 with a single story industrial building. At the time, the <br />building was occupied by a wholesale meat processing business. In 1974, a variance was <br />approved to expand the existing building by adding a second story component to house <br />office space for the tenant. In 1982, an ice cream manufacturing business took over the <br />site. Several tenant improvements were performed, however, in 2002, the building <br />suffered damages due to a fire. Although substantial, the building was reconstructed and <br />the ice cream business continued to operate until January of 2020 when Chilly Willy <br />Desserts moved in.
