• Facilities, equipment and personnel used; <br />• Facilities and equipment operations, maintenance and repair; <br />• Number of Refuse, Recycling and Organics Contractor -owned Containers in service; <br />• Complaints; and, <br />• Missed pickups. <br />Contractor shall maintain copies of said Billings and receipts, each in chronological <br />order, for a period of five (5) years after the date of service and shall make said <br />documents available for inspection by City upon request. Contractor may, at its option, <br />maintain those records in computer form, on microfiche, or in any other manner, <br />provided that the records can be preserved and retrieved for inspection and verification <br />in a timely manner, are sufficient to verify accuracy of any Fees owed to the City, and <br />may be produced in a form and manner sufficient to establish the existence of Customer <br />obligations in a court of competent jurisdiction. <br />8.2.4 CERCLA Defense Records <br />City views the ability to defend against the Comprehensive Environmental Response, <br />Compensation and Liability Act (CERCLA), State Hazardous Substance Law, and <br />related litigation as a matter of great importance. For this reason, the City regards the <br />ability to prove where Solid Waste Collected in the City was taken for Disposal, as well <br />as where it was not taken, to be matters of concern. Contractor shall maintain data <br />retention and preservation systems which can establish where Solid Waste Collected in <br />the City was landfilled (and therefore establish where it was not landfilled) and provide <br />a copy or summary of the reports required in Section 8.3 for five (5) years after the term <br />during which Collection services are to be provided pursuant to this Agreement, or to <br />provide copies of such records to City. Contractor agrees to notify City's Risk Manager <br />and City Attorney before destroying such records and to offer records to the City. This <br />provision shall survive the expiration of the period during which Collection services are <br />to be provided under this Agreement. <br />8.2.5 Disposal Records <br />Contractor shall maintain records of Disposal of all Solid Waste Collected in City for the <br />period of this Agreement and all extensions to this Agreement or successor <br />August 17, 2021 124 City of Santa Ana <br />
