ORDINANCE NO. NS-16?3 <br />PAGE FOUR <br /> <br />director shall take action on the request by either approving, <br />conditionally approving or denying such request. If the <br />request is approved or conditionally approved by the director, <br />the director may reclassify the building into a lower rating <br />classification. In so reclassifying the building, the <br />director shall consider the total occupant load as certified <br />by the owner and multiply said figure by two. The occupant <br />load of the building as determined by the director shall be <br />in lieu of utilizing Table No. 33-A of Chapter 33 of the <br />Uniform Building Code. The reduced occupancy load as determined <br />by the director shall be used only for the purposes of this <br />article and not for the purpose of satisfying the requirements <br />of any other provision of the Santa Ana Municipal Code. <br /> <br /> (c) APPEAL FROM DIRECTOR'S DECISION. If the director <br />denies the request for reclassification, or approves the <br />request but attaches one or more conditions which the owner <br />finds objectionable, the owner may appeal the director's <br />decision to the Uniform Code Appeals Board in the manner <br />authorized by Subsection(d) of Section 8-2004. All appeals <br />shall be filed with the Uniform Code Appeals Board within <br />thirty(30) days after the date of the director's decision. <br /> <br /> (d) RECERTIFICATION BY OWNER. Con~mencing on January <br />31st of the year after which the director has approved or <br />conditionally approved the owner's request for reclassification <br />under this section, and each year thereafter until the <br />building is brought into compliance with the provisions of <br />this article, the owner shall submit to the director a <br />statement certifying that the occupant load of the building <br />has not changed during the previous reporting period. If <br />any annual recertification filed by an owner with the director <br />indicates that the occupant load of the building has increased <br />so as to result in a possible upward change of classification <br />(e.g. from low risk, or Class IV, to medium risk, or Class <br />III, etc.) or if the director learns of any such increased <br />occupant load from any other source, the director, upon <br />fifteen(15) days prior written notice to the owner, may hold <br />a hearing for the purpose of reclassifying the building to <br />a higher classification. The owner may present any oral or <br />written evidence at said hearing, and be represented by <br />counsel. Within fifteen (15) days after the close of said <br />hearing, the director shall provide written notice to the <br />owner of his decision. The director's decision may be <br />appealed by the owner to the Uniform Code Appeals Board in <br />the manner provided in Subsection (d) of Section 8-2004. <br /> <br /> <br />
