In Re <br /> <br />Salary Return <br /> <br />of Chief of Police. <br /> <br /> The element of good sportsmanship has always <br />been a part of our American life, whether in athletics, <br />politics, or other contesting issues, and it seems to me <br />that I should have at least been extended the courtesy of <br />being asked to explain this alleged misuse of city proper- <br />ty at the same time Councilman LeGaye made h~ statement <br />to the Council. <br /> On the other hand, I was not aware he was going <br />to make such a report before the Council, and was not <br />asked to appear at the time the accusations were made, <br />either to explain or defend. I think as a public official <br />and law enforcement officer, I should have been notified <br />to appear so I could present my side of the c cntroversy. <br /> Not having an invitation to appear before the <br />Council, I can only interpret, as I am sure the voter will <br />interpret, that the charges were made to impair my candi- <br />dacy for Sheriff, inasmuch as it reflected an improper <br />use of city equipms~t and material. <br /> I am content to leave Councilman LeGaye's <br />charges and my explanation to the fairness of the Council <br />and the voter for decision. <br /> So far I have not found it either nemessary or <br />expedient to resort to petty larceny in the conduct of my <br />campaign, nor have I anything to conceal in the offical <br />conduct Sf my nine years of service as a law enforcement <br />officer in Santa Aha and Orange County. I esteem the pub- <br />lie's good will and respect too highly to resort to such <br />practices as were inferred in Mr. LeGaye's statements. <br /> Respectfully submitted, <br /> (Signed) Floyd W. Howard <br /> Chief o~ Police of the Cit~ <br /> of Santa Ana. <br /> <br />On motion of Trustoe Penn, seconded by Bruns and carried, <br /> <br />the report of the Police Commissioner and the communica- <br /> <br />tion of Floyd W. Howard, Chief of Police, were accepted <br /> <br />and ordered made a part of the record. <br /> <br />In order to make the record complete, Trustee LeGaye made <br />a motion that the clipping from the Santa Ana Daily Regis- <br />ter published June 19, 1933,relative to the Chief of <br />Police returning a percentage of his salary to the City <br />of Santa Aha, be made a part of the minutes. The motion <br />was lost for lack of a second. <br /> <br />In Re <br /> <br />Resolution <br /> <br />Appropriations <br /> <br />from City Budget. <br /> <br />Trustee LeGaye presented the following Resolution for <br /> <br />adoption: <br /> <br /> "RESOLVED, that it shall be the policy of the City <br />Council in making up its annual budget for the year 1934- <br />35, that no money shall be budgeted or set aside from the <br />treasury of the City, which is to be directly or indirect- <br />ly contributed to any private group or organization, nos <br />shall any money be so appropriated, except for the abso- <br />lutely necessary functions of government and then only in <br />amounts absolutely necessary and to be expended by those <br />duly and regularly elected officals, so that the respon- <br />sibility for such expenditure can be placed by the voter <br />upon such officals." <br /> <br />At the suggestion of Trustee Rowland, the resolution was <br /> <br />tabled for one week for further study. <br /> <br />In Re <br /> <br />Ordinance <br /> <br />Regulating Sound Trucks. <br /> <br />An Ordinance was introduced regulating sound trucks adver- <br />tising on the streets of Santa Ana. The Ordinance was <br />read, considered and on motion of Trustee Bruns, seconded <br />by RoWland and carried, referred back to the City Attorne <br /> <br />On motion of Trustee Bruns, seconded by Penn and carried, <br />the City Council adjourned to Monday, J~Xly 9th, 1934, at <br /> <br /> <br />
