Claborn for leave of absence, effect- ive July 1st, 1945, motorcycle officer in the Police Dept., to Join the armed forces was read. On motion of Trustee Dixon, seconded by Cheney and carried, request was granted and communication received and filed. Report of McFadden and Turner, Attorneys, covering examination of the original agreements relating to the Joint acquisition and maintenance of Section i of the Joint 0utfall Sewer, was read and on motion of Trustee Dixon, seconded by Deckert and carried, the report was received and filed. On motion of Trustee Deckert, seconded by Cheney and carried, Resolution No. 40 of the Planning Commission was sustained denying the application for a Variance of the Trinity Luthex~an Church to build a church and school in an R-1 District, on the northwest corner of Orange and McFadden Sts. described as Lots 9, l0 and ll, Block "B" of Realty Subdivision, of Lot I of McFadden Wilson Tract. On motion of Trustee Haan, seconded by Dixon and carried, Resolution No. 42 of the Planning Commission denying application of Board of Education for a Zone Change to construct a Junior College on property on 17th and North Bristol Streets, was referred back to the Planning Commission for rehearing for the reason that there seeme( to be a misunderstanding of the property owners with reference to taxation. Herb Alleman and N.D.Herdlinger appeared before the Board protesting action of the Council. The Clerk read the protests of A.J.Dewald, W.R.Bennett and J.G.Quick against the granting of a variance to the Case-Swayne Co. to construct a warehouse on Lots 11, 13 and 1S, Block "B", Gardner Villa Tract. Oral protests were heard from Wm. J. Turpin and property owners in the vicinity. Stanley Reinhaus, representing the Case-Swayne Co. explained the compromise offer of the Company to withdral their application ~$ the westerly §0 ft. lot, described as Lot 11 Block "B" Gardner Villa Tract and agreeing not to ask for a variance for five years and to improve the property with a fence, lswn or cement. Petitions with names of Mrs. Ella J. Motry, O.W.Humphrey~ Carolyn V. Humphrey and Martha Humphrey attached, with- drawing their protests against the application of the
