Claborn for leave of absence, effect- <br /> ive July 1st, 1945, motorcycle officer in the Police <br /> Dept., to Join the armed forces was read. <br /> <br /> On motion of Trustee Dixon, seconded by Cheney and <br /> carried, request was granted and communication received <br /> and filed. <br /> <br /> Report of McFadden and Turner, Attorneys, covering <br /> examination of the original agreements relating to the <br /> Joint acquisition and maintenance of Section i of the <br /> Joint 0utfall Sewer, was read and on motion of Trustee <br /> Dixon, seconded by Deckert and carried, the report was <br /> received and filed. <br /> <br />On motion of Trustee Deckert, seconded by Cheney and <br />carried, Resolution No. 40 of the Planning Commission <br />was sustained denying the application for a Variance of <br />the Trinity Luthex~an Church to build a church and school <br />in an R-1 District, on the northwest corner of Orange <br />and McFadden Sts. described as Lots 9, l0 and ll, Block <br />"B" of Realty Subdivision, of Lot I of McFadden Wilson <br />Tract. <br /> <br />On motion of Trustee Haan, seconded by Dixon and <br />carried, Resolution No. 42 of the Planning Commission <br />denying application of Board of Education for a Zone Change <br />to construct a Junior College on property on 17th and <br />North Bristol Streets, was referred back to the Planning <br />Commission for rehearing for the reason that there seeme( <br />to be a misunderstanding of the property owners with <br />reference to taxation. <br /> <br />Herb Alleman and N.D.Herdlinger appeared before the <br /> <br />Board protesting action of the Council. <br /> <br />The Clerk read the protests of A.J.Dewald, W.R.Bennett <br />and J.G.Quick against the granting of a variance to the <br />Case-Swayne Co. to construct a warehouse on Lots 11, 13 <br />and 1S, Block "B", Gardner Villa Tract. <br /> <br />Oral protests were heard from Wm. J. Turpin and property <br />owners in the vicinity. <br /> <br />Stanley Reinhaus, representing the Case-Swayne Co. <br />explained the compromise offer of the Company to withdral <br />their application ~$ the westerly §0 ft. lot, described <br />as Lot 11 Block "B" Gardner Villa Tract and agreeing <br />not to ask for a variance for five years and to improve <br />the property with a fence, lswn or cement. <br /> <br />Petitions with names of Mrs. Ella J. Motry, O.W.Humphrey~ <br />Carolyn V. Humphrey and Martha Humphrey attached, with- <br />drawing their protests against the application of the <br /> <br /> <br />
