SECTION 12. PERMANENT HEADERS. <br /> When noted on the plans, the Contractor shall provide permanent headers, whenever <br /> thc ~avcment does not terminate against a curb, gutter, or other pavement. The perman- <br /> ent header shall consist of a sound redwood plank two (2) inches thick and of a width <br /> not less than the thickness of the pavement. The top edge of the plank shall conform to <br /> the street cross-section when finished. Said headers shall be considered a necessary part <br /> of the pavement and shall remain in place until replaced by permanent improvement, and <br /> no additional compensation will be allowed for the same. <br /> <br />SECTION 12. LABOR. <br /> The Contractor shall employ none but competent foremen, laborers and mechanics. Any <br /> overseer, superintendent, laborer, or other person employed on the work by the Contractor, <br /> who is intemperate, incompetent, or who fails or refuses to perform the work in the manner . <br /> specified therein, shall be discharged immediately, and such person shall not again bc <br /> en~ployed on the work. <br /> In the absence of the Contractor from the work, whether permanent or temporary, he <br /> must provide and leave a competent and reliable agent or foreman in charge. <br /> All notices, communications, orders or instructions given or sent to, or served upon <br /> such agent or foreman shall be taken as served upon the Contractor. <br />SECTION I4. PRESERVATION OF MONUMENTS, <br /> The Contractor shall not disturb any monuments or stakes found on the line of im- <br /> provements without permission from the City Engineer, and shall bear the expense of <br /> resetting ~ny monuments or stakes which may be disturbed without such permlsslml. <br /> The Contractor shall reset all street name signs disturbed by him during the progress <br /> of the work. <br /> <br />SECTION IS. REMOVING OBSTRUCTIONS. <br /> The Contractor shall remove trees where required by thc plans or where the proper <br /> completion of the work requires their removal. The Contractor shall also remove all <br /> stone, debris or other obstructions of whatever kind or character, either n_atural or arti. <br /> ficlal, encountered in making the improvement, or when noted on the plans to be removed. <br /> <br /> SECTION 16. OBSERVING LAWS. <br /> The Contractor, and all labor employed by him, shall observe all the Ordinances of <br /> the City of Santa Ana, in relation to the obstruction of streets, keeping passageways open <br /> and protecting the same where they are exposed or dangerous to travel; also such other <br /> ordinances and State and Federal laws as shall affect the Contractor during the progress of <br /> the work. Rules of the Boards of Health shall be observed and the Contractor shall take <br /> reasonable steps to insure proper sanitation in connection with all of his activities. <br /> <br />SECTION 17. CROSS STREETS. <br /> Any streets intersecting the street in which the work is being done may be closed <br /> at any time, provided that each alternate street intersecting the said street is kept olden. <br />SECTION 18. BARRIERS, LIGHTS, ETC. <br /> The Contractor shall take all necessary measures to protect the work and prevent <br /> accidents during the construction. He shall provide and maintain all necessary barriers, <br /> guards, temporary bridges, watchmen and lights. <br /> <br />SECTION 19. SUSPENSION OF WORK. <br /> The Superintendent of Streets shall have authority to suspend the work on account of: <br /> {1)default of Contractor, (2) unfavorable weather conditions, and (3) any other condition, <br /> which in the judgment of the Superintendent of Streets, makes it impracticable to secure <br /> <br /> <br />
