RESOLUTION NO. 65-5 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA, CALIFORNIA, ORDERING THE INCLUSION OF CERTAIN ADDITIONAL TERRITORY IN ASSESSMENT DISTRICT NO. 221. (Assessment District No. 221, Watkins Way) WHEREAS, in proceedings under the Improvement Act of 1911 (co~m~encing at Section 5000, Streets and Highways Code) this City Council adopted Resolution No. 64-185 proposing the inclusion of certain additional territory in Assessment District No. 221, as shown on No.a ma~21,,,designatedconsisting"Revisedl~aPof one sheet,°f Assessmentshowing theDiStriCtboundaries of the district after the inclusion of such territory and fixing a time and place of hearing by this City Council on said proposed changes; and WHEREAS, said Resolution No. 64-185 was duly published and a copy thereof mailed to all persons owning real property within said additional territory, whose names and addresses appear on the last equalized assessment roll or as known to the Clerk, all in the time and manner provided by law; and WHEREAS, the contractor for said work has given his written consent to the making and ordering of the changes described in said Resolution No. 64-185; and WHEREAS, at the hearing on the proposed inclusion of said additional territory all persons desiring to be heard were fully heard, and all oral and written protests or objections, if any, were fully heard and this City Council gave all persons present an opportunity to hear and be heard in respect to any matter relating to the proposed changes; and WHEREAS, the evidence received at said hearing indicated that Parcel No. 57, as shown on said "Revised Map of Assessment District No. 221", is provided with sanitary sewer service by drainage into a pre-existing sewer in McFadden Avenue but that Parcel No. 58, as shown on said map, can be provided with sanitary sewer service only by drainage into the sewer constructed in Newhope Street pursuant to said proceedings. NOW, THEREFORE, the City Council of the City of Santa Aha, California, DOES HEREBY RESOLVE, DETERMINE AND ORDER as follows: Section 1. Each and all oral and written protests, except any protesting the inclusion of Parcel No. 57 in said assessment district, which were made or filed in the matter be and the same are hereby overruled and denied.
