<br /> That the definition of "co~Eission merchant broker"
<br />
<br />and "s~ock-bond broker", shall remain as originally set forth
<br />
<br />in Ordinance No. 658.
<br />
<br /> That the following paragraph defining real estate
<br />
<br />broker and salesman be added to Section 98, under definition,
<br />and shall dead as follows: "For the purpose of this ordinsnce,
<br />the term "real estate Broker" is defined to be any person, co-
<br />partnership, or corporation, who, for a compensation sells,
<br />or offers for sale, buys, or offers to buy, or negotiates the
<br />purchase or sale or exchange of real estate, or who, for com-
<br />pensation negotiates loans on real estate, leases, or offers
<br />to lease, rent, or places for rent, or collects rent from real
<br />estate, or improvement thereof, as a whole or partial vocation.
<br />
<br /> ^ real estate salesman, within the meaning of this
<br />ordinance is one who for a compensation or commission, is em-
<br />ployed by a licensed broker to sell, or offer for sale, or to
<br />buy, or to offer to buy, or to negotiate a loan on real estate,
<br />or to lease, or offer to lease, rent, or place for rent, any
<br />real estate or improvements thereon, as a whole or a partial
<br />vocation.
<br />
<br /> Every broker who hires or uses a salesman either on
<br />co~Eission or otherwise, shall be liable to the City of Santa
<br />
<br />Ana for the salesman's license fee provided for in this ordinance.
<br />
<br /> It shall be prima facie evidence of doing a real
<br /> salesman
<br />estate broker or real estate/business in the City of Santa Ana
<br />
<br />if the records of the State Real Estate Commission show the
<br />name of any person thereon at the first of the last preceding
<br />collection date of license taxes within the City of Santa Ana.
<br />
<br /> 3. That Ordinance No. 658 of the City of Santa Ana,
<br />
<br />and Section 42 thereof which reads as follows: "For every
<br />person, firm or corporation, conducting, managing or carrying
<br />on the business of selling f~uits or vegetables from a vehicle,
<br />other than as a peddler, and having no fixed place Of ~usiness
<br />in the City of Santa Ana, $8.00 per day for each such vehicle",
<br />is hereby amended so as to read as follows: "For every person,
<br />firm, or corporation, conducting, managing or carrying on the
<br />business of selling fruits or vegetables from a vehicle, other
<br />than as a peddler, and having no fixed place of business in the
<br />City of Santa Ana, $10.00 per day for each such vehicle".
<br />
<br /> Provided, that every, person, fi~m, or corporation~
<br />applying for the licehse Set forth in Section 42 of thi§ 0~di~
<br />nance, shall before the issuance of said permit, file with the
<br />City Clerk a penal bond for $~00.00, execute~ by a surety com-
<br />pany or by two responsible free holders residing in the City of
<br />San~a Ana, (or cas~n equal amount), conditioned upon his or
<br />their compliance with the terms of the license issued and the
<br />good faith of said applicant; provided further, that no license
