373 <br /> <br />of a permit is in excess of $50.00, the applicant shall deposit the <br />sum of $100.00 in addition to the sum chargeable hereunder for the per- <br />mit, and from said deposit the Superintendent of Streets shall deduct <br />the sum of $10.00 for the ~ssuance of a permit for the moving of a <br />building containing not ober fi~e hundred square feet of total floor <br />space, including the floor space of any floor or part thereof above <br />the first, and $10.00 for each addition ten square feet of floor <br />space or fraction thereof~ and also the sum of $20.00 for each twenty- <br />four (24) hours or fraction thereof during which the building occu- <br />pies any portion of a public street in the operation of moving in <br />excess of the first twenty-four (24) hours. <br /> <br /> In addition to the first deposit of $200.00 the applicant <br />for the permit shall, before the issuance thereof, in the case of <br />every building containing more than five hundred square feet of floor <br />space, file with the Street Superintendent a bond in the sum of <br />$1,000.00, issued by a surety company authorized to do business in <br />the State of California, in a form approved by the City Attorney of <br />the City of Santa Ana, conditioned that if the principal shall fail <br />to fully pay any person, firm or corporation including the City of <br />Santa Ana, who or which sahll suffer any damage that may be done to <br />the streets or improvements thereon, or to any person or property of <br />any description'as a result of the moving of such building, the <br />amount of such bond. Such bond shall be so conditioned that it may <br />be recovered upon at the suit and in the name of any person, firm or <br />corporation so injured. <br /> <br /> The Superintendent of Streets shall also deduct from said <br />deposit the cost of the service rendered by any employee of said <br />City, in protecting, trimming or cutting any trees along the route <br />of moving. In the event that it becomes necessary to move, or re- <br />place or otherwise change any poles, conduits, standards, wires or <br />other property of utilities, in the streets, which are placed and <br />located acceding to law, franchise and the regulations of the Rail- <br />road Commission of the State of Calif~ nia, governing such locations, <br />the reasonable expense of removal and replacement of same shall be <br />borne by the housemover and deducted ~rom the deposit made by the <br />Street Superintendent, provided the person, firm or corporation <br />owning or controlling said poles, wires, etc., shall have filed with <br />the Street Superintendent an estimate of said work within 48 hours <br />of the time of the service of the Notice of Application of Building <br />Moving permit, as is hereinbefore provided. <br /> <br />Wherever such poles, wires, etc., are placed with less <br />clearance than that specified in the laws, and regulations pertain- <br /> <br />ing to such matters, <br />borne by the person, <br />operating same. <br /> <br />SECTION V. <br />~rdinance provided for be <br /> <br />the expense of removal and replacement shall be <br />firm, corporation or municipality owning or <br /> <br />Should the cash deposit hereinbefore in this <br /> inadequate to pay the respective claims <br /> <br /> <br />
