ORDINANCE NO. 878 <br /> <br />AN ORDINANCE OF THE CITY G~ SANTA ANA REGULATING <br />THE USE OF DEVICES OR APPARATUS WHICH INTERFERES <br />WITH RADIO BROADCAST RECEPTION; A~gD PROVIDING <br />THE PENALTY FOR A VIOLATION THEREOF. <br /> <br /> The City Council of the City of Eanta Ana do ordain as follows: <br /> <br /> Section 1. It shall be Unlawful for any pers6n, firm or corporation to <br />operate in the City of Santa Ana any apparatus generating or causing high frequen¢ <br />oscillations which interferes with radio broadcast receiving apparatus, or <br />wireless receiving apparatus, between the Hours of six o'clock P.M. and eleven <br />o'clock P.M.; except that a person duly licensed to practice medicine, osteopathy <br />chiropractic or dentistr~ by the State of California, in a case of absolute <br />emergency arising in the course of practice of his profession, and which case <br />demands immediate treatment between the aforementioned hours, may operate, or <br />cause to be operated under his direct supervision, any machine necessary to give <br />an emergency treatment in such case. <br /> <br /> Section 2. Any device or apparatus such as violet Ray Machines, machln <br />using the Tesla Coil or principle, X-Ray Machines and Diathermy machir~s which <br />interfere with the intelligibility of radio ~ece~$iQn, u~®~ all the following <br />conditions shall be considered as coming within the terms of this Ordinance: <br /> <br /> (a) Such device or apparatus must be situated One Hundred (100) <br /> <br />£eet or more from the receiving equipment with which it interferes. <br /> <br /> (b) The radio receiving equipment interfered with shall be operated <br />on a volume comparable to a person speaking in a normal tone of vo~ e. <br /> <br /> (c) The broadcasting station whose program is being received when the <br />i~terference occurs must have a power output of at least I K.~. and ~ust be <br />located not more than forty (40) miles distant from the receiving set. <br /> <br /> It is expressly understood and provided, however, that this Ordinance <br />shall not apply to radio stations, either broadcast, commercial, or amateur, <br />licensed by the Federal Government, or which are engaged in interstate <br /> <br /> public utilities under the supervision of the State Railroad <br /> <br />commlnuication, or to <br />Commission. <br /> <br /> Section 3. <br /> <br /> The City Electrician of the City of Santa Ana shall have <br />the right to enter upon any premises in said City, at all reasonable hours, <br />for the purpose of inspecting the installation and working of all apparatus <br />coming within the terms of this Ordinance and it shall be unlawful for any <br />person, f~rm or corporation to interfere with the City Electrician in making such <br />inspection, or to refuse to permit the said City Electrician to enter the <br />premises £or such purposes. <br /> <br /> Section 4. ~nen an inspection and test shall have been made by the <br />City Electrician as herein provided for, and it is found that equiMnent or <br />apparatus coming within the terms of this Ordinance is being operated in violatio <br />of the terms hereof, the person or persons responsible for the ope~ation of <br />such equipment shall be notified in writing to discontinue the use of such <br />machine or apparatus, or to make additions, repairs or modifications thereof <br />in order that the same may be operated in a manner ~.£nich complied with the <br />provisions of this ordinance.
