In case of any inconsistency or omission, the rates <br />fixed by any such applicable Federal order, whether higher or <br />lower, shall control. <br /> <br /> In accordance with the provisiorsof Section 1777.5 of <br />the Labor Code, as amended by Chapter 971, Statutes of 1939, and in <br />accordance with the regulations of the California Apprenticeship <br />Council, properly indentured apprentices may be employed in the <br />prosecution of this work. <br /> <br /> The above listed rates are based upon a working day of <br />eight (8) hours, being proportionately applicable to eight (8) <br />hours or less of employment in any one calendar day other than <br />Saturdays, Sundays and the following seven legal holidays: <br /> <br />New Year's Day, Memorial Day, Fourth of <br />July, Labor Day, Armistice Day, Thanksgiving <br />Day and Christmae, where any work is required <br />in case of extraordinary emergency caused by <br />fire, flood or danger to life or property. <br /> <br /> For any working time of more than eight (8) hours in any <br />one calendar day and for time worked on Saturdays, Sundays and any <br />of the aforementioned holidays, not less than one and one-half time <br />the specified rates shall be paid. <br /> <br />APPROVED and ADOPTED this 17th day of September, 1962. <br /> <br />ATTEST: <br /> <br /> CLERK' OF THE COUNCIL <br /> <br />-2- <br /> <br /> <br />
