RESOLUTION NO.63-76 OF THE CITY <br />COUNCIL OF THE CITY OF SANTA ANA, <br />CALIFORNIA, DETERMINING, ASCERTAIN- <br />ING AND FIXING THE GENERAL <br />PREVAILING RATE OF PER DIEM WAGES <br />AND THE GENERAL PREVAILING RATE <br />FOR HOLIDAY AND OVERTIME WORK <br />FOR EACH CRAFT, CLASSIFICATION OR <br />TYPE OF WORKMAN NEEDED TO EXECUTE <br />A3~L CONTRACTS FOR PUBLIC WORK IN <br />SAID CITY AND REPEALING RESOLUTION <br />NO. 62-175. <br /> <br /> WHEREAS, pursuant to general law and the <br />charter of the City of Santa Ana, this City Council <br />from time to time awards contracts for, or authorizes <br />public work in, the City of Santa Aha; and <br /> <br /> WHEREAS, before awarding any contract for <br />public work this City Council is required, under the <br />provisions of the Labor Code (commencing at Section 1770), <br />to determine, ascertain and fix the general prevailing <br />rate of per diem wages and the general prevailing rate <br />for holiday and overtime work for each craft, classification <br />or type of workman needed to execute any such contract; <br />and <br /> <br /> WHEREAS, the City Council has ascertained and <br />considered the applicable wage rates established by <br />collective bargaining agreements and such rates as may have <br />been predetermined for federal public works within the <br />City of Santa Ana, and in the nearest labor market area, <br />and such further data from labor organizations and <br />employers or employers' associations, as this City Council <br />deems necessary for ascertaining the rates actually <br />applying in said city. <br /> <br /> NOW, <br />of Santa Ana, <br />AND ORDER, as <br /> <br />THEREFORE, the City Council of the City <br />California, DOES HEREBY RESOLVE, DETERMINE <br />follows: <br /> <br /> Section 1. This City Council hereby <br />determines, ascertains and fixes the general prevailing <br />rate of per diem wages and the general prevailing rate <br />for holiday and overtime work for each craft, classification <br />or type of workman needed to execute any public works <br />contract awarded or authorized by this City Council, <br />and such rates shall be as described and set forth in <br />the schedules marked Schedule "A" and Schedule "B", <br />which schedules are attached hereto, incorporated herein <br />and made a part hereof as though fully set forth herein. <br /> <br /> Section 2. Not less than said rates, fixed <br />as herein provided, shall be paid to all workmen employed <br />on public works, exclusive of maintenance work. <br /> <br /> Section 3. From time to time as changes <br />occur in any such rates or any new and different rates <br />prevail in said city, the City Council may either repeal <br />this resolution and adopt a new resolution determining, <br />ascertaining and fixing such rates or amend or supplement <br />this resolution by determining, ascertaining and fixing <br />such changed, new or different rates and for that purpose <br /> <br /> <br />
