1. The unlawful manufacture, distribution, dispensing, possession or use <br />of a controlled substance is prohibited in the workplace for any employee involved <br />in a federally funded program. <br />2. As an employee working in conjunction with a federally._._funded pro- <br />gram, the employees of SUBRECIPIENT will be required to: <br />a) Abide by the terms of statement 1. <br />b) Notify appropriate officials of SUBRECIPIENT and Santa Ana offi- <br />cials of any criminal drug statute conviction for a violation occurring in the work- <br />place not later than five days after such conviction. <br />3. The United State Department of Housing and Urban Development will <br />be notified within ten days after receiving notice of any such violation. <br />4. Within 30 days of receiving such notice, appropriate personnel action <br />will be taken against such employee, up to and including termination. <br />5. Each such employee shall be required to participate satisfactorily in a <br />drug abuse assistance or rehabilitation program approved for such purposes by a <br />federal, state or local health, law enforcement, or other appropriate agency. <br />P. SUBRECIPIENT certifies that it will develop and implement procedures to <br />ensure the confidentiality of records pertaining to any individual provided family <br />violence prevention or treatment services under any project assisted under the <br />Emergency Shelter Grants Program and that the address or location of any family <br />violence shelter project assisted under the Emergency Shelter Grants Program will, <br />except with written authorization of the person or persons responsible for the op- <br />eration of such shelter, not be made public. <br />Q. SUBRECIPIENT certifies that it will involve, to the maximum extent prac- <br />ticable, homeless individuals and families in constructing, renovating, maintaining, <br />and operating facilities assisted under the ESG program, and in providing services <br />for occupants of these facilities. <br />R. SUBRECIPIENT agrees that except for the use of ESG funds to pay sala- <br />ries and other related administrative or personnel costs, no persons who exercise or <br />have exercised any function with respect to ESG activities assisted under the terms <br />of this Agreement, or who are in a position to participate in a decision -making proc- <br />ess or gain inside information with regard to such activities, may obtain a financial <br />interest or benefit from an ESG-assisted activity of SUBRECIPIENT, either for them- <br />selves or those with whom they have family or business ties, during their tenure or <br />for one year thereafter.
