RESOLUTION 66-126 APPROVING MAP, DECLARING
<br />INTENTION TO VACATE CERTAIN RIGHT OF WAY
<br />ON THE SOUTH SIDE OF AVALON AVENUE, EAST OF
<br />HATHAWAY STREET, RESERVING AN EASEMENT
<br />TI-~REIN FOR PUBLIC UTILITIES, AND GIVING
<br />NOTICE OF HEARING THEREON
<br />
<br /> WHEREAS, a request for the vacation of certain right of way on the South
<br />side of Avalon Avenue, East of Hathaway Street, herein described, has been
<br />received by the City Council, and the Department of Public Works and the Planning
<br />Commission have recommended that a public hearing be set on the question of
<br />said vacation;
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED: That the City Council hereby
<br />approves the map attached hereto and orders the same filed with the original of
<br />this Resolution in the office of the Clerk of the Council, and reference is hereby
<br />made to said map for the exterior boundaries of said right of way proposed to be
<br />vacated.
<br /> The City Council declares its intention to proceed under the provisions
<br />of the Street Vacation Act of 1941 (Sections 8500 through 8374 of the California
<br />Streets and Highways Code) to vacate that certain right of way, 30 feet in width,
<br />on the south side of Avalon Avenue, east of Hathaway Street and RESERVING
<br />THEREIN an easement for utility structures for the Pacific Telephone Company
<br />and the Southern California Edison Company. Said right of way proposed to be
<br />vacated lies in the City of Santa Ana, County of Orange, State of California
<br />and is described as:

<br />Beginning at the Southwest corner of Lot i of Tract 4528 as
<br />shown on a map thereof, recorded in Book 162, pages 3 and
<br />4, Miscellaneous Maps, records of Orange County, California
<br />thence North 0° 09' 19" West 119.80 feet along the West line
<br />of said Lot 1 to the beginning of a tangent curve concave
<br />Southeasterly and having a radius of 15.00 feet; thence
<br />Northeasterly along said curve through a central angle of
<br />90° 08~ 40TM an arc distance of 23.60 feet to a tangent line;
<br />thence South 89° 59' 20" West 45.11 feet along said tangent
<br />line to the Northeast corner of Lot 57 of Tract 5910 as shown
<br />on a map thereof, recorded in Book 217, pages 49 and 50,
<br />Miscellaneous Maps, records of Orange County, California;
<br />thence South 0° 09' 19" East and along the East line of said
<br />Lot 57 and its Southernly prolongation a distance of 134.83
<br />feet; thence South 89O 58' 59" East 30.00 feet to the point
<br />of beginning.

<br />RESERVING an easement and right of way to construct, lay, install,
<br />use, maintain, alter, add to, repair, replace, inspect and/or
<br />remove, at any time and from time to time, aerial and underground
<br />electric lines and communication lines, consisting of poles, guys,
<br />and markers and other fixtures and appliances, for conveying
<br />electric energy to be used for light, heat, power, telephone and/or
<br />other related uses, in, on, over, under and through that certain
<br />real property in the City of Santa Ana, County of Orange, State of
<br />California, described as follows:

<br />The Southerly 6.00 feet and the Westerly 6.00 feet of the above
<br />described property.
<br />
<br /> BE IT FURTHER RESOLVED: That these proceedings are taken subject
<br />to the reservations and exceptions next hereinabove set out.
