RESOLUTION NO. 7~-lz <br /> <br />RESOLUTION DETERMINING THAT THE PUBLIC CONVENIENCE <br /> AND NECESSITY REQUIRE IMPROVEMENT WORK <br /> <br />ASSESSMENT DISTRICT NO. 236 <br />SANTA ANA, CALIFORNIA <br /> <br /> WHEREAS, the City Council of the City of Santa Aha, <br />California did, on the 17th day of November~ 1969, in adopting <br />its Resolutions No. 69-173 and 69-174 in thxs assessment district, <br />order that a public hearing be held on.the 5th day of January, <br />1970 at 7:30 o'clock P.M. in the councxl chambers in the Cxty <br />Hall in said City of Sant9 Aha concurrently with the protest <br />hearing under its Resolutzon of Intention No. 69-174 for the pur- <br />pose of finding and determining whether the public convenience and <br />necessity require the improvements proposed to be constructed as <br />described in said Resolution of Intention No. 69-174; and <br /> <br /> WHEREAS, notice of the adoption of said Resolution No. <br />69-173 and of said Resolution of Intention No. 69-174 by mailing, <br />posting and publication was given in the time, form and manner as <br />required by law, as shown by the affidavits of mailing, posting and <br />publication on file in the office of the Clerk of the Councxl of <br />said City of Santa Ana; and <br /> <br /> WHEREAS, said City Council continued said hearings until <br />Monday, February 16, 1970 at 7:30 o'clock P.M., rejected bids <br />received for construction of said improvements, and ordered that <br />new bids therefor be sought, returnable on February 16, 1970; and <br /> <br /> WHEREAS, protests or objections, in writing or otherwise, <br />made by the owners of more than half of the area of the property to <br />be assessed for said improvements against the proposed work and <br />improvement, the extent of the district to be assessed, or the grades <br />to which said work is proposed to be done, have not been made or <br />presented up to the hour set for hearing in and by said Resolution <br />of Intention No. 69-174, and no person, other than owners of pro- <br />perty within said assessment district, appeared at said public <br />hearings and made objections that the public convenience and <br />necessity did not require such improvement; and <br /> <br /> WHEREAS, said City Council received testimony from the <br />Director of Public Works of said City of Santa Ana that said pro- <br />gosed work and improvement in the assessment district proposed to <br /> e assessed for such work and improvement is, in his opinion, <br />required for the public convenience and necessity. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of the <br />City of Santa Aha, California, in regular session assembled this <br />16th day of February, 1970, that said City Council hereby finds <br />and determines that said proposed work and improvement zs feasible, <br />and that the public interest, convenience and necessity requir?
