Sec. 9111 <br />of Code <br /> <br />In Re <br />Variance <br />Alfred J.Guttierez <br /> (see Minutes <br /> <br />In Re <br />Tentative Map <br />Tract No. 2322 <br /> <br />A petition was read signed by 31 residents in the 1300, 1400 and 1500 <br />blocks of Martha Lane stating that the spot zoning of the lot on the <br />northeast corner of Martha Lane and Pacific Street to an R-3 zone will <br />be detrimental to'the value of the remaining property in the neighbor- <br />hood zoned R-1 and requesting denial of the spot zoning. On motion <br />of Councilman Larsen, seconded by Jerome and carried, the pe$1tion <br />was received and filed. K. Harrison, 1424 Martha Lane objected ~o <br />the continued use of the apartment on the rear of the let and to the <br />proposed R-3 zone. Blair M. White stated they were unaware that a <br />petition had been circulated protesting the variance and that the <br />number of signatures did not represent the large majority it would <br />indicate. It was moved by Councilman Dahl, seconded by McBride and <br />carried, that a Resolution be adopted reversing the recommendation of <br />the Planning Commission and granting the variance to permit construct- <br />ion of the single-family residence on the basis of the lot being <br />located on th~ corner of Pacific Street and Martha Lane and the apart- <br />ment facing on Pacific Street, subject to the conditions of the <br />Department of Public Works that construction of sidewalk and curb and <br />paving out to existing pavement on Pacific Street are needed to bring <br />it up to present City standards; the Council having unanimously waived <br />the reading of the Resolution, the following Resolution entitled: <br /> <br /> "Resolution No. 54-157 granting variance on <br /> application No. 525 where the Planning Commission <br /> recommended that the same be denied" <br /> <br />was considered and passed <br /> <br /> Ayes, Councilmen <br /> <br /> Noes, Councilmen <br /> Absent, Councilmen <br /> <br />by the following vote: <br /> <br />William Jerome, J.L.McBride, <br />Thomas F. Lateen, Milford W. Dahl <br />Courtney R. Chandler <br />None <br /> <br />Communication was read from the Planning Commission recommending that <br />the Attorney be requested to amend Section 9111 of the Municipal Code, <br />and other necessary Sections, to add "auto wrecking and salvage yards" <br />to the list of uses prohibited in said Section, and on motion of <br />Councilman McBride, seconded by Larsen and carried, the communication <br />was received and filed. On motion of Councilman Dahl, seconded by <br />Larsen and carried, the matter was referred to the Attorney to prepare <br />and submit to the Planning Commission amendments to Section 9111 of the <br />Municipal Code. <br /> <br />Communication was read from the Planning Commission correcting an ever- <br />sight in the granting of variance to Alfred J. and Frieda Guttier~ez <br />to construct and operate a drive-in restaurant at 1331-37 W. 1st <br /> <br />Street and recommending that a sign be approved, the size and location <br />of sign to comply with the requirements of the present Sign Ordinance. <br />On motion of Councilman Jerome, seconded by McBride and carried, the <br />recommendation of the Planning Commission was approved and variance <br /> <br />amended granting'sign. <br />. <br />On motion of Councilman McBride, <br />Tentative Map of Tract No. 2322, <br />on property located at the <br /> <br /> seconded by Jerome and carried, <br /> <br /> submitted by Baker Development Company, <br />continuation of Linwood Street south from <br /> <br /> <br />
