RESOLUTION 71-13 AFFIRMING THE DECISION OF THE <br />PLANNING COMMISSION AND GRANTING A VARIANCE ON <br />VARIANCE APPLICATION 70-68 FILED BY THE FIRST <br />WESTERN BANK & TRUST COMPANY, SUBJECT TO <br />APPLICABLE CONDITIONS <br /> <br /> WHEREAS, after public hearing on notice, the Planning <br />Commission granted a variance on Variance Application 70-68 <br />filed by FIRST WESTERN BANK & TRUST COMPANY to waive a portion <br />of the required off-street parking and permit a service station <br />and automobile service facility in a shopping center in the C R <br />District at 3600 South Bristol Street, Santa Ana, California; <br />and <br /> <br /> WHEREAS, Appeal Application 254 was duly filed by the <br />Department of Public Works appealing conditions 4(e) and 4 (d) <br />and presenting the matter to the City Council; and <br /> <br /> WHEREAS, Appeal Application 258 was duly filed by JAN L. VAIL <br />and ROBERT EWING ASSOCIATES appealing the decision of the Planning <br />Cormnission and presenting the matter to the City Council; and <br /> <br /> NOW, THEREFORE, BE IT RESOLVED: That based upon the Finding <br />of Fact of the Planning Commission, the City Council of the City of <br />Santa Ana hereby affirms the decision of the Planning Commission <br />and Appeal 254 filed by the Director of Public Works is hereby <br />DENIED; <br /> <br /> BE IT FURTHER RESOLVED: That the City Council of the City <br />of Santa Ana does hereby affirm the decision of the Planning <br />Commission and does hereby grant a variance on Variance Application <br />258 to permit the waiver of the required off-street parking and <br />permit a service station and automobile service facility in a <br />shopping center in the CR District at 3600 South Bristol Street, <br />Santa Ana, California, in the CR District; said Variance is <br />granted subject to the following conditions: <br /> <br />That a revised plot plan be submitted to and approved by the <br /> the Planning Department indicating: <br /> (a) The proposed service station will be located on the <br /> corner with two curb cuts permitted to both Sunflower <br /> and Bristol Streets. The developer will also provide <br /> deceleration lanes along the service station frontage <br /> on both of these Streets. Landscaping is to be equal <br /> to or better than the service station installation at <br /> the Treasury located in the City of Orange at Manchester <br /> Street and Garden Grove Boulevard. <br /> (b) A 4-foot high solid wall or fence in front of the <br /> automobile service bays to screen the use from Sunflower <br /> Avenue. <br />Development shall be according to the revised plot plan except <br /> for minor modifications approved by the Planning Department. <br /> <br />e <br /> <br />That a landscape plan he submitted to and approved by the <br /> Planning Department conforming to the landscape requirements <br /> in the CR District (one tree for each 20 parking spaces, 2% <br /> of gross uncovered parking area to be landscaped, etc.), but <br /> including minimum 5-foot wide landacaped planters adjacent <br /> to all street frontages and 8-foot wide landscaped planters <br /> in the public right of way in place of sidewalks which have <br /> been waived, except at approved driveways. Said landscaping <br /> shall be implemented according to the landscape plan, be <br /> permanently maintained and be provided with automatic irri- <br /> gation devices. <br /> <br />-1- <br /> <br /> <br />
