RESOLUTION 71-13 AFFIRMING THE DECISION OF THE PLANNING COMMISSION AND GRANTING A VARIANCE ON VARIANCE APPLICATION 70-68 FILED BY THE FIRST WESTERN BANK & TRUST COMPANY, SUBJECT TO APPLICABLE CONDITIONS WHEREAS, after public hearing on notice, the Planning Commission granted a variance on Variance Application 70-68 filed by FIRST WESTERN BANK & TRUST COMPANY to waive a portion of the required off-street parking and permit a service station and automobile service facility in a shopping center in the C R District at 3600 South Bristol Street, Santa Ana, California; and WHEREAS, Appeal Application 254 was duly filed by the Department of Public Works appealing conditions 4(e) and 4 (d) and presenting the matter to the City Council; and WHEREAS, Appeal Application 258 was duly filed by JAN L. VAIL and ROBERT EWING ASSOCIATES appealing the decision of the Planning Cormnission and presenting the matter to the City Council; and NOW, THEREFORE, BE IT RESOLVED: That based upon the Finding of Fact of the Planning Commission, the City Council of the City of Santa Ana hereby affirms the decision of the Planning Commission and Appeal 254 filed by the Director of Public Works is hereby DENIED; BE IT FURTHER RESOLVED: That the City Council of the City of Santa Ana does hereby affirm the decision of the Planning Commission and does hereby grant a variance on Variance Application 258 to permit the waiver of the required off-street parking and permit a service station and automobile service facility in a shopping center in the CR District at 3600 South Bristol Street, Santa Ana, California, in the CR District; said Variance is granted subject to the following conditions: That a revised plot plan be submitted to and approved by the the Planning Department indicating: (a) The proposed service station will be located on the corner with two curb cuts permitted to both Sunflower and Bristol Streets. The developer will also provide deceleration lanes along the service station frontage on both of these Streets. Landscaping is to be equal to or better than the service station installation at the Treasury located in the City of Orange at Manchester Street and Garden Grove Boulevard. (b) A 4-foot high solid wall or fence in front of the automobile service bays to screen the use from Sunflower Avenue. Development shall be according to the revised plot plan except for minor modifications approved by the Planning Department. e That a landscape plan he submitted to and approved by the Planning Department conforming to the landscape requirements in the CR District (one tree for each 20 parking spaces, 2% of gross uncovered parking area to be landscaped, etc.), but including minimum 5-foot wide landacaped planters adjacent to all street frontages and 8-foot wide landscaped planters in the public right of way in place of sidewalks which have been waived, except at approved driveways. Said landscaping shall be implemented according to the landscape plan, be permanently maintained and be provided with automatic irri- gation devices. -1-
