No. 56-123 <br />Denying modification <br />of building setback line <br />on Broadway <br /> <br />In Re <br />Hearing <br />Parallel parking <br />along Fourth Street <br /> <br />In Re <br />Variance <br />~edicof%ice s, Inc. <br /> <br />On motion of Councilmsn Jerome, seconded by DSb] and carried, the recommendation <br /> granted <br />of the Planning Commission was approved and the variance of David Jackm~_/to permi~ <br /> <br />the use of property at 1139 West Third Street for construction of a one-bedroom <br />duplex, overall dlmeusians 40' x 25', on front of said property, facing Third Stree <br />in addition to existing dwelling on rear of lot, subject to certain conditions and <br /> <br />the further condition that the parking a~a ~be blacktopped as shown oh plot <br /> <br />plan. <br /> <br />On motion of Councilman Jerome, seconded by Dahl and carried, the recommendation <br />of the Planning Commission was approved and the variance of Forrest V. Grossman <br />granted to permit construction of a one-bedroom duplex, with three garage spaces, <br />on rear part of lot at 1008 North Patton Street, subject to certain conditions. <br />This being the date set for hearing protests on the amendment application of James <br />H. Kindel, Jr., for the reclassification of property on both sides of North Broad- <br />way from Tenth Street to Washington Avenue, from the R-3 to the C-2 District, Dr. <br />Russell Langenbeck presented a petition signed by thirteen property owners protest- <br />ing the rezoning of this property. On motion of Councilman Dahl, seconded by <br />Jerome and carried, the petition was received and filed. Asa Hoffman, 1012 North <br />Broadway, said he was in favor of the rezoning to the C-2 District if the setback <br />was eliminated. Attorney R~bert Barnes, on behalf of the applicant, gave <br />reasons why this property should be rezoned to a commercial district. The Council <br />having unanimously waived the reading of the Resolution, on motion of Councilman <br />Markel, seconded by Jerome and carried, the following Resolution entitled: <br /> <br /> "Resolution No. 56-122 denying application for amendment changing <br /> district classification where Planning Commission made no <br /> re commendation <br /> <br />was considered and passed by the following vote: <br /> <br />Ayes, Councilmen Dale H. Chandler <br />Noes, Councilmen None <br />Absent, Councilmen None <br /> <br />The Clerk read communication from Attorney Otto A. Jacobs, on behalf of the Fourth <br />Street merchants, submitting petitions signed by 2778 customers of the various <br />stores indicating their preference for dingone! parking on Fourth Street. On <br />motion of Councilman Heinly, seconded by Markel and carried, the communication and <br />petitions were received and filed. Mr. Jacobs explaio~.d the merchants' attitude <br />towards changing the diagonal parking to parallel parking and stated 108 parking <br />sts~lls would be removed in the process. Numerous merchants voiced their <br />to the abolishment of diagonal parking and the establishment of parallel parking. <br />Hearing declared closed and no further action taken. <br /> <br />Communication was read from the Planning Commission recommending approval of <br />variance application of Medicoffices, Inc., to permit the decrease of l0 foot rear <br />yard to 3 feet, on property at 2036 North Broadway, in connection with erection of <br />a modern office building for medical doctors, but request for deletion of 3 foot <br />side yard on south side of the lot be denied.
