On motion of <br /> Councilman Markel, seconded by Gould and carried, the matter was continued until <br /> the next regular meeting. <br /> <br /> Coemmmication was read from the Planning Commission recnmme, nding approval of <br /> <br /> Variance Application No. 1085 filed by Ralph C. Anderson to permit moving of exist- <br /> ing nursery business back 75 feet to comply with dedication of land right-of-way and <br /> widening of Seventeenth Street, and at the same time create off-street parking space <br /> and expand existing building facilities; and to erect a sign, 50 square feet in size, <br /> to lie flat against the building or on top of building, on property situated at <br /> <br /> 1222 East Seventeenth Street, in R-2 District. The applicant protested the condition <br /> requiring construction of sidewalk but stated he would dedicate the property and <br /> bear the expense of curb and gutter. The Council having unanimously waived the <br /> reading of the Resolution, on motion of Counc1~m~n Gould, seconded by Hubbard and <br /> carried, the following Resolution entitled: <br /> <br /> "Resolution No. 59-67 granting Variance on Application No. <br /> as recommended by the Planning Conmission by deleting one condition" <br /> <br /> was considered and passed by the following vote: <br /> <br /> Ayes, Councilmen Royal E. Hubbard, Stanley C. Gould, Jr., <br /> A. A. Hall, J. Ogden Markel, Dale H. Heinly <br />Noes~ Councilm~n None <br />Absent, Councilmen None <br /> <br /> Cnmmunication was read from the Planning Commission recoam~nding denial of Variance <br /> Application No. 1078 filed by Carl K. Pearlm~n~ M.D. to enlarge existing medical <br /> building, deleting portions of the yard requirements on the south side of the property <br /> for a distance of 16 feet at the east end of building and 32 feet at west end of <br /> building, on property situated at 1518 North Sycamore Street, in R-3 District. <br /> Attorney Robert Jacobs, on behalf of Mrs. ~m~a Childers, objected to the Variance <br /> as it would be detrimental to his client's building depriving the tenants of <br /> sufficient light in the offices. Attorney Milford W. r~hl, representing the appli- <br /> cant, presented the Council with copies of the plot plan, a letter from Carl D. <br /> Cronin, D.D.S., stating he has no objection to the Variance Application; also, a <br /> letter from Dr. Pearlman advising that the Variance Application to extend his build- <br /> ing on the rear portion of the property is withdrawn and the only portion on which <br /> a Variance is requested is the extension of a small front section. Attorney Milford <br /> W. Dahl explained that Mrs. Childers and Dr. Pearlm~an operate a joint parking lot <br /> and the construction to the rear of the property would eliminate some parking area; <br /> the applicant has a problem so far as storage space is concerned, and this area is <br /> being devoted to professional use. Attorney Robert Jacobs stated Mrs. Childers <br /> constructed her building after Dr. Pear~ma~ the overb-~g of the roof goes up to <br /> about i foot of the property line but adhered to the 5 foot set-back line; does not <br /> believe this application shows grounds for a Variance as there is no hardship upon <br /> the land and it is purely a personal acconm~dation requested by the applicant. On <br /> motion of Colznc~lm~n Hall, seconded by Markel and carried, the reccmm~endation of <br /> the Planning Commission was approved and the Variance denied. <br /> <br /> Roll C~] Ayes, Counc~n Royal E.
