<br /> On motion of Councilman Huobard, seconded by Hall and carried, the protests
<br /> were received and filed. George N. MacA~evin, 2246 Oak Street, stated he
<br /> had transferred five feet of property to the city in March, 1959, and felt
<br /> he had oeen charged for i~rovement to sm~e. The Director of Fublic Works
<br /> answered his inquiries. The ~a~or asked if *.he cost was in excess of the
<br /> ~riginal estimate, and the Director of Public Works indicated t~mt it was.

<br /> The Mayor also inquired as to why these protests were filed for excessive
<br /> charges and felt a report should ce made due to the complaints. £he foll-
<br /> owing individuals protested relative to excessive chargea, damage to
<br /> curbs, driveways, and fences and an explanation as to how the charges were

<br />Hentges, 17472 S. Alewhope. The Director of Public Works explained the
<br />various charges, including the district charge for engin~ering~ legal
<br />fees, inspection, advertising, etc. At the request of the Mayor, the
<br />
<br /> Director of Public ~orks retired to an adjacent room to answer in detail
<br /> questions regarding the above matters. Mr. Kemeth Carter of Sully-
<br />
<br /> Miller Company, contractc~ on the job, was present, and spoke in defense
<br />
<br /> of the work. It was moved by Uouncilman Hubbard, secoDAed by Gould s~d
<br /> carried that t~ hearing be continued to May 18, 1959.

<br /> On motion of Counciln~n Hubbard, seconded by Hall and carried, the recommen-
<br /> dation of the Planning Ccam~ission was approved, and Variance Applicatic~
<br />
<br /> No. 1099 filed by W. C. Connell and Jack L. Jarman granted to construct
<br />
<br /> a commercial b~ilding, 80 feet by 100 feet in size, to be used for whole-
<br /> sale food Ousiness, off-street parking space to be provided for 52 cars,
<br /> all as sho~ on plot plan on property situated at 12422 ~est Seventeenth Street,
<br />
<br /> in R-1 District, subject to conditions.

<br /> The Council, having unanimously waived the reading of the Resolution, on
<br /> motion of Councilman Hubbard, seconded by Brewer and carried, the following
<br /> Resolution entitled:
<br />
<br /> "Resolution No. 59-106 of the City Council of the City of
<br /> Santa A~a ordering Certain modifications in those proceedings
<br /> for the improvement of Towner Street and other streets instituted
<br /> pursuant to Resolution No. 59-37 (A.D. 202)"

<br />The Manager submitted a tabulation of oids for the improvement of Towner
<br />Street et al in Assessment District No. 202 and stated three bids were
<br />received. Also, this is a very complex Assessment~ District; C~x Brothers
<br />submitted a l~ bid of *17,118.75 but as the low bid is 15% to 20% higher
<br />than the bid anticipated, he requested postponement of the award of the
<br />bid in order to check the property owners in the area to see if this
<br />additmmal cost is acceptable and tore-compute the total amount of the
<br />
