Rose <br /> <br />Prelminary Record <br />of Survey - Joseph Taylor <br /> <br />bid and the next lowest bidder. 'the Clerk swore in ~udy ~. Gallegos. Mr. <br />Gallegos stated in Alternate No. 2 he was personally responsible for the trans- <br />posing of a decimal point which read $1,200.00 instead of the intended <br />$12,000.00. This error was due to the rush and confusion as the firm was <br />late in getting all the figures together. Mr. Schlegel presented a bid sheet <br />showing the figures compiled by Mr. Gallegos. He cited the Lemoge Electric <br />vs County of San Mateo case in which there was no meeting of the minds. Nylin <br />Hurd stated he was second low bidder and did not feel the bid in question can <br />be corrected. The Mayor read a letter from Harold Gimeno, and on motion of <br />Councilman Hubbard, seconded by Hall and carried, the communication was received <br />and filed. The Mayor inquired if Mr. Gallegos wanted his original bid to <br />stand. Mr. Schlegel stated that Gallegos did not want to withdraw his bid; <br />t~re may be a question of declaratory relief and said the City Attorney's <br />Opinion No. 217 indicated the bid cannot be amended. On motion of Councilman <br />Gould, seconded by Brewer and carried, the matter was continued until June l, <br /> <br /> C ' <br />1959, and The Gallegos orporatlon granted permissiG~ to file a written state- <br /> <br />ment of the law involved. <br />. <br />A tabulation of bids was presented for the construction of revised electrical <br /> <br />service for the S~ta Aha Public Library and Police Facility Ouilding as <br /> <br />follows~ <br /> <br />Giloert & Stearns, Inc. <br />Sherwin Electric Service <br /> <br /> Total <br /> oo <br />$11,920. O0 <br /> <br />5~ bid bond <br />5% bid bond <br /> <br /> On recommendation of the Manager and on motion of Councilman Hubbard, seconded <br /> by Brewer and carried, the~id of Gilbert & Stearns, Inc. in the total amount <br /> of $10,756.00 was accepted, and all other bids rejected. <br /> <br />On motion of Councilman Hubbard, seconded by Brewer and carried, Tentative ~ract <br />Map 3416, filed by Hodges Building Corporation, creating 14 industrial lots <br />located generally 1000 feet north of McFadden Street on the west side of McClay <br />Street, was approved, subject to conditions. <br /> <br />On motion of Councilman Hubbard, seconded by Hall and carried, action was <br />continued to June l, 1959, on Preliminary Record of B~vey filed by H. L. <br /> <br />Dady redefining lot lines and joining property located generally on the east <br />side of °Ullivan Street between Fairview Avenue (~est McFadden Avenue) and <br /> <br />Monta Vista Avenue. <br /> <br />On motion of Councilman Huobard, seconded by ~all and carried, action was <br />continued to June l, 1959, on Preliminary ~ecord of Ourvey filed by Haviland <br /> <br />V. Smith dividing a parcel located generally on the south side of Oelhi Road, <br />620 feet east of Bristol Street. <br /> <br />Communication was read from John H. Siegel, Civil Engineer, on behalf of ~r. <br />and Mrs. Oeorge H. Rose, requesting deferral of action for an indefinite period <br />of time on Tentative ~ap of Tract ~o. 27~8 on property situated generally between <br />First and M~rtle Streets, and 365 feet east of ~ullivan Otreet, and on motion <br />of Councilman Hall, secouded by Brewer and carried, the request was granted. <br /> <br />On motion of Councilman Hubbard, seconded by Brewer and carried, Preliminary <br />Record of Smrvey filed by Joseph D. Taylor creating three parcels located gen- <br />erally 320 feet west of Main Street ~ the south side of Delhi ~oad, was approved~ <br />subject to conditions. <br /> <br /> <br />
