No. 59-231 <br />(Off calendar +/ <br /> Aug. 17, 1959) <br /> <br /> ,Ordinance amending Article IX of the Santa Aha Munic[pal Code to <br /> change district classifications on Amendment Application No. 280 <br /> and to amend Sectional District Map 9-5-10, Exhibit B" <br /> <br />was introduced, considered and placed on file for second reading. <br /> <br />This being the date set for hearing on Amendment Application No. 281, initiated by <br />Planni~ Commission, amending Sectional District Map 9-5-9, Exhibit C, to reclas- <br />sify from R-1 District to C-1-PK District, property situated generally on the east <br />side of Tustin Avenue, between a point 540 feet north of the north line of First <br />Street and a point 1,571 feet north of the north line of First Street, measured at <br />a depth of 557 feet east of the east line of TustLu Avenue. Dixon W. Tubbs, <br /> <br />14732 Tustin Avenue, stated that he is partial owner and trustee for other owners <br />of this property;and in view of the fact that the Freeway is going to take the <br />property, they are endeavoring to secure land for commercial development in the <br />area. The hearing was closed. It was moved by Councilman Gould and secomied by <br />Brewer, that the follow~ng Ordinance entitled: <br /> <br /> "Ordinance changing district classification on Application <br /> No. 281t <br /> <br />be introdacedj considered and plac~ion file for second reading. Councilma~ Hubbard <br />dis~lualified h~mself on this matter. G~ McHenry, 14871 Tustin Avenue, protested <br />any change in zoning of this particular area and requested that he be permitted <br />to read the letter signed by him, dated August 10, 1959, addressed to the Planning <br />Commission, wherein he set out the reasons for his protest. Hubbard <br /> <br />Communication was again read frcm the Planning Commission recommmnding approval of <br />Variance Application No. 1135, filed by Elite Sal es Corporation, to construct <br />thirty-six triplexes on thirty-six lots, on property situated between Hobart and <br />Edinger Streets, ~mmediately west of the James Madison School and Park, subject to <br />conditions. Attorney Walter H. Steiner, representing applicant, stated all con- <br />ditions have been clarified, and the Planning Commission has approved the ~ew map <br />now on file. -:On motion of Counc~]man Hubbard, seconded by B~ewer a~d carried, the <br />recomnem~ation of the Planning Commission was approved and Variance Application <br />No. 1135, filed by Elite Sales Corporation, wa~ granted, subject to conditions. <br />Communication was again read from the Planning Commission recommending den~l of <br />Variance Applicatic~ No. ll60, fif~d by Alfred H. and Edna H. Stennett, to estab- <br />lish an office and a storage yard fc~ heavy equipment om property situated at <br />14695 South Vera~o Street, in R-1 District. Communication was read from Mr. end <br />Mrs.M~lack protesting the granting of this Variance. On motion of Councilman Gould, <br /> received and <br />seconded by Hubbard and carried, the communication wap/filed. AttorneY W, J. Clemons, <br /> <br />on behalf of the applicant, stated there are other businesses in this particular <br />area, such as a service stationj welding shop, grocery store, etc. The building <br />has been changed into au office building, and if the Variance is gra~ted will have <br />stored therein only two tractors, two trucksa and no gasoline, and no burning of <br />oil will be permitted. The applicant has dane considerable work on the yard and <br />will construct a fence as high as necessary at the back ofthe yard. Also, the <br />district has a business right across the street, storing eight or ten times more <br />equipment thm~ will be stored in this building.
