Attorney Harry Knisely, on behalf of the <br /> <br />applicant, remarked his client has no definite plans to build and were concerned <br />with the 121-foot strip only, not zoned R-S and which is a part of the entire <br /> <br />parcel purchased for the develupment of Tract 3533 being developed as R-B lots. <br /> <br />Re stated they were not aware the 12cl.-foot strip, or 7 lots, was not in the R-3 <br /> <br />District whe~ this parcel was purchased, and if retained as R-1 would represent a <br /> <br />hardship; the property to the east is now M-l; the north property has already been <br /> <br />zoned C-1. The hearin~ was closed. It was moved by Councilman Brewer, seconded by <br /> <br />Gould and carried, that Variance Application No. 1257 be denied. <br /> <br />Roll Call Ayes, Councilmen Stanley C. Nuhbard <br /> Absent, Councilmen None <br /> <br />On motion of Counc~lm-n Heinly, seconded by Hubbard and carried, the recommendation <br /> <br />of the Planning Cr=~s~ion was approved and Variance Application No. 1251, filed by <br /> <br />Wi]lard Walter Bickford, to construct a one-story duplex (one bedroom each unit); <br /> <br />a single-family dwelling exists on the lot; on property at 53~1. West Third Street, <br /> <br />in the R-1 District, was denied. <br /> <br />O.'~,.~,unication was read from Rita Writer regarding Variance ~pplication No. 1169, <br /> <br />granted September 8,1959, and requesting permission to rent office space to Dr. <br /> <br />Beverl~ J. Triplett, Physician-Surgeon~ for her limited practice. On motion of <br /> <br />Councilman Hub~rd, seconded by Gould and carried, the matter was referred to the <br /> <br />Planning Co~mission for proper determination and recommendation. Counc~n Helnly <br /> <br />disqualified himself on this matter. <br /> <br />Councilman Heinly left the meeting at 9:15 P.M. <br /> <br />Communication was read from the Planning Co~ission reccemending approval to estab- <br /> <br />blish future right-of-way lines on the following street: <br /> <br />(bb) McFadden Avenue <br /> <br /> Between the Santa Aha River and Fairview Street, on both sides, measured 42 <br />feet l~rom and at right angles to the su~rvey center line. <br /> Between Fairview Street and Cla~a Street, on the north side, measured 5~ feet <br />from and at right angles to the survey center line. <br /> Between Fairview Street and Clara Street, on the south side, measured ~0 feet <br />from and at right angles to the survey center line. <br /> Between Clara Street and a point 211 feet east of the center lineof Clara <br />Street, on the north side beginning at a point on the center line of Cl~wa Street <br />5k feet north of the center line of McFadden Avenue and extending easterly to a <br />point ~2 feet north of the center line of McFadden Avenue and 211 feet east of the <br />center line of Clara Street; and on the south side beginning at a point on the <br />center line of Clara Street ~0 feet south of the center line of McFadden Avenue and <br />extending easterly to a point 211 feet east of the center line of Clara Street and <br />~2 feet south of the center line of McFadden Avenue. <br /> Between Broadway and a point 211 feet east of the center line of Clara Street, <br />on both sides measured 42 feet from and at right angles to the survey center line <br />of McFadden Avenue. <br /> Between Broadway and Main Street, measured on both sides, kO feet from and at <br />right angles to the survey center line of McFadden Avenue. <br /> Between Main Street and the east corporate ltmtts measured on both sides k2 <br />feet from and at right angles to the survey center line of McFadden Avenue. The <br /> <br />Council having unanimously waived the reading of the Resolution, on motion of Court- <br /> <br />cilman Hubbard, seconded by Brewer and carried, the following Resolution entitled: <br /> <br />"Resolution No. 60-30 declaring intention to establish future right- <br />of-way lines along portions of McFadden Avenue and fixing date of <br />hearing thereon" <br /> <br />setting the date of hearing on March 21, 1960, was considered and passed by the <br /> <br />following vote: <br /> <br />Ayes, Councilmen <br />Noes, Councilmen <br />%bsent, Counciimen <br /> <br />Royal E.
