Hearing <br />Amend. Appl. No. 519 <br />initiated by Plann.Comm. <br />Ordinance <br /> <br />Appeal Appl.No. 1 <br />Variance Appl.No. 1B7h <br />Harry Po jackson <br />Re so. No. 60 -176 <br />granting Appeal <br /> <br /> R-1 District~ no protests were received and the hearing was closed. On motion of <br /> <br /> Councilman Gould, seconded by Hubbard and carried~ the following Ordinance entitle~ <br /> <br /> "Ordinance amending Article IX of the Santa Ana Municipal Code <br /> to change district classification on Amendment Application <br /> No. 318 and ~mending Sectional District Map 30-5-9 (Exhibit 318-A)" <br /> <br /> was introduced, considered and placed on file for second reading. <br /> <br /> This being the date set for hearing on Amendment Application No. 319, initiated by <br /> the Planning Commission, amending Sectional District Maps 27-5-10 and <br /> <br /> Exhibit 319-A and B19-B, respectively, to reclassify from R-1 to the M-1 Districts <br /> property bounded on the north by Segerstrom Avenue, on the south by Huntzinger <br /> Avenue, on the east by proposed Fairview Street, and on the west by Harbor Bouleva <br /> no protests were received and the hearing was closed. On motion of Councilman <br /> Hubbard, seconded by Heinly and carried, the following Ordinance entitled: <br /> <br /> "Ordinance amending Article IX of the S~%uta Ana Municipal Code <br /> to change district classification on A~endment Application <br /> No. 31g and amending Sectional District Maps 27-5-10 and <br /> 3h-5-10 (Exhibits 319-A and 319-B)" <br /> <br /> was introduced, considered and placed on file for second reading. <br /> <br />Appeal ApPlication No. i of Harry P. Jackson was presented on Variance Applicatio~ <br />NO. 1B7h, for the off sale of beer and wine at 1206 South Standard Avenue~ in the <br />Palm Shopping Center~ located on the southwest corner of Standard and McFadden <br />Avenues~ wherein Planning Commission recommended denial for the off sale of beer <br />and wine. Attorney John Cochran, 601 First Western Bank Building, stated the real <br />party in interest is his client, Mr. ;~. J. Miller, owner of Tiny Tim Markets, who <br />leased the property fr°m Edward M. Hall, and the hardship has been caused through <br />the change in ownership by Harry P. Jackson. Attorney Cochran requested that his <br />client's supermarket be permitted the off sale of beer and wine as is generally <br />sold by supermarkets. Bert Ryssman, 903 E. McFadden Avenue, spokesman for four <br />persons who stood in protest, objected to the sale of beer and wine at this market <br />as this would create the littering of cans'and Jugs in the neighborhood, and stated <br />when the construction of the store was proposed, there was no mention of the off <br />sale of beer and wine~ also there is a school and a church nearby~ and the residen' <br />wish to retain a good appearance of their property. Major Clyde Stamps~ Marine Co~ <br />825 E. Harvard Place, stated there would be a change in the character of this resi. <br />dential community if the appeal is approved, as it will result in an increase in <br />the auto traffic by drinking drivers. Also, there are many multiple dwellings in <br />this area, and the resultant littering problem will further degrade this neighbor- <br />hood. He further stated that this type of business should be in a business area <br />other than the one selected. Attorney Cochran remarked that with respect to the <br />market selling beer and wine, and the traffic disturbance of people making such <br />purchases, the Tiny Tim Market at 1302~ Newport Avenue experiences no problem in <br />the sale of beer and wine. The Council having unanimously ~ived the reading of <br />the Resolution, on motion of Councilman Gould~ seconded by Hubbard and carried, th <br />following Resolution entitled: <br /> <br /> "Resolution No. 60-176 granting Variance on Application No. 137h <br /> where the Planning Commission reco~mnended denial" <br /> <br />was considered and passed by the following vote: <br /> <br />Ayes, Councilmen Royal E. Hubbard, Stanley C. Gould, Jr., Dale H. Heinly, <br /> Bob Brewer, A. A. Hall <br />Noes, Councilmen None <br />Absent, Councilmen None <br /> <br /> <br />
