Variance Appl.No .1240 <br />Orange County Law Bldg. <br /> <br />Communication <br />Planning Commission <br />Vacate portion <br />Riverine Street <br /> <br /> ~he Appelant, Mrs. Ruth B. Harmer, 412 Vance Street, stated court proceedings were <br /> <br /> court <br /> started in April to get/approval to encumber her husband's interest in the property~ <br /> <br /> which has been owned by them for 33 years, and permission was Just received from <br /> the courts to proceed on the basis of the six-unit apartment house only. Chris <br /> Marsh, 412 Vance Street, stated he had checked with the Planning Department prior <br /> to the adoption of the Land Use Ordinance and was advised the setback and side yard <br /> requirements were acceptable, and consequently the property went into escrow in <br /> April, 1960. He presented pictures of a SOO-foot area depicting the established <br /> setbacks on Vance and Lacy Streets; also an alternate plan of the proposed property~ <br /> which has 9,600 square feet, and Exhibit "A" indicating the 80-feet rights-of-way <br /> on Vance and Lacy Streets, stating most of the streets are sixty feet in width, <br /> including any new subdivisions. Further, if the court decision had been received <br /> prior to the ch~uge in the Land Use Ordinance, an appeal would not have been ne- <br /> cessary for the constraction of this six-unit apartment house. The Council having <br /> unanimously waived the reading of the Resolution, on motion of Councilman Gould, <br /> seconded by Hubbard and carried, the following Resolution entitled: <br /> <br /> "Resolution No. 60-189 granting Variance Application No. <br /> on Appeal Application No. <br /> <br /> was considered and passed by the following vote: <br /> <br /> Ayes, Councilmen Royal E. Hubbard, Stanley C. Gould, Jr., A. A. Hall <br /> Noes, Councilmen Bob Brewer <br /> Absent, Councilmen Dale H. Heinly <br /> <br />Attorney Milford W. Dahl, representing the Orange County Law Building property, aga$ <br />orally requested Council consideration of Variance Application No. 12~O, insofar as <br />it pertains to the extension of an existing law and accounting office building at <br /> <br />812 No. Birch Street, which matter was continued from the previous meeting. Attorne~ <br />Dahl reiterated his client's objection to the further dedication of five feet for <br />setback purposes, inasmuch as eight fee~ had already been dedicated, but stated that <br />on conferring with his clients they have agreed to the further dedication of five fe~t <br />which would be in sidewalk area. It was moved by Councilman Gould, seconded by <br />Hubbard and carried, that Variance Application No. 1240 be granted, insofar as it <br />pertains to the extension of an existing law and accounting office building at 812 <br />No. Birch Street, subject to all conditions as imposed by the Planning Department a~ <br />the Department of Public Works, and the further condition of the dedication of 30 feet <br />from the center line of Eighth Street <br /> <br />Comm~uication was presented from the Planning C~mmfssion recommending approval of <br />proposed vacation and abandonment of all that portion of Riverine Street lying be- <br />tween Tenth Street and 150 feet north of Eighth Street, except at the southerly end <br />of the portion to be abandoned, the County construct a cul-de-sac to City standards, <br />so as to provide adequate turn-around maneuvering space for vehicles used in conjunc- <br />tion with business on the parcels fronting on the remaining portions of Riverine <br />Street, immediately south of the proposed abandonment · Further, it is noted that <br />there is apprcximately 150 feet of frontage under private ownership on both sides <br />Riverine Street, Immediately north of Eighth Street. These privately owned parcels <br />would be on a stubbed street with inadequate turn-around space for emergency fire- <br />fighting equipment, etc., if the cul-de-sac were not constructed. On motion of <br />Councilman Hubbard, seconded by Gould and carried, the communication was received <br />and filed. <br /> <br /> <br />
