408

Facts in Support of Findings

The significant effect has been substantially lessened to the extent feasible by virtue of the design
considerations by the project applicant and the traffic and air quality mitigation measures
identified in the Final EIR and incorporated into the project. These measures are identified in
the Traffic/Circulation and Air Quality sections of this Statement of Findings.

Although these measures will lessen the impact of land use intensification, the effect remains
cumulatively significant. This impact is acceptable when weighed against the facts set forth in the
Statement of Overriding Considerations.

TRAFFIC/CIRCULATION

Significant Effect

Project-related traffic will contribute to the deficient operation of certain intersections in the
vicinity of the project site. With recommended improvements to be implemented by, or with funds
contributed by, the project applicant and other developers in the area, certain intersections will
be improved to acceptable levels of operation. However, certain intersections will continue to
operate above (more deficient than) the desired level of service (Level of Service D). Under
existing plus project conditions (and with thc recommended feasible improvements), the
intersection of MacArthur Boulevard and Fairview Street would continue to operate at Level of
Service F. In addition, the following intersections would operate above Level of Service D under
the existing plus project plus other new developments (cumulative) condition: 1-405/Harbor
Boulevard (eastbound ramps), (-405/Fairview Road (eastbound and westbound) ramps, Fairvicw
Street/MacArthur Boulevard, and Hyland Avenue/MacArthur Boulevard.

Findings

Finding 1: Changes or alterations have been required in, or incorporated into, the project which
avoid or substantially lessen the significant environmental effect identified in the final
EIR.

Finding 2: Such changes or alterations are within the responsibility or jurisdiction of another public
agency and not the agency making the finding. Such changes have been adopted by
such other agency or can and should be adopted by such other agency

JBI/08850001.SOF

20
