408 <br /> <br />Facts in Support of Findings <br /> <br />The significant effect has been substantially lessened to the extent feasible by virtue of the design <br />considerations by the project applicant and the traffic and air quality mitigation measures <br />identified in the Final EIR and incorporated into the project. These measures are identified in <br />the Traffic/Circulation and Air Quality sections of this Statement of Findings. <br /> <br />Although these measures will lessen the impact of land use intensification, the effect remains <br />cumulatively significant. This impact is acceptable when weighed against the facts set forth in the <br />Statement of Overriding Considerations. <br /> <br />TRAFFIC/CIRCULATION <br /> <br />Significant Effect <br /> <br />Project-related traffic will contribute to the deficient operation of certain intersections in the <br />vicinity of the project site. With recommended improvements to be implemented by, or with funds <br />contributed by, the project applicant and other developers in the area, certain intersections will <br />be improved to acceptable levels of operation. However, certain intersections will continue to <br />operate above (more deficient than) the desired level of service (Level of Service D). Under <br />existing plus project conditions (and with thc recommended feasible improvements), the <br />intersection of MacArthur Boulevard and Fairview Street would continue to operate at Level of <br />Service F. In addition, the following intersections would operate above Level of Service D under <br />the existing plus project plus other new developments (cumulative) condition: 1-405/Harbor <br />Boulevard (eastbound ramps), (-405/Fairview Road (eastbound and westbound) ramps, Fairvicw <br />Street/MacArthur Boulevard, and Hyland Avenue/MacArthur Boulevard. <br /> <br />Findings <br /> <br />Finding 1: Changes or alterations have been required in, or incorporated into, the project which <br /> avoid or substantially lessen the significant environmental effect identified in the final <br /> EIR. <br /> <br />Finding 2: Such changes or alterations are within the responsibility or jurisdiction of another public <br /> agency and not the agency making the finding.
