090 <br /> <br />3.0 <br /> <br />4.0 <br /> <br />AUTHORITY TO REQUIR t:, AND ENFORCE AB 3180 <br /> <br />The City of Santa Aha is required to enforce the provisions of AB 3180, <br />consistent with its existing Police powers. As lead agency for the <br />environmental documentation for the proposed 15roject and the agency with <br />the authority to approve the proposed project, the City is also the agency <br />responsible for approving the Mitigation Monitoring/Reporting Program and <br />for accepting the written report(s) documenting the completion of the <br />implementation of the mitigation measures. The Public Works Agency of the <br />City will be responsible for coordinating the Mitigation Monitoring Program <br />with the appropriate City departments and outside contractors and <br />consultants. <br /> <br />PROPOSED MmGATION MONITORING PROGRAM <br /> <br />Table 1 summarizes the mitigation measures for Chapter IV, the appropriate <br />schedule for implementation of each measure and the City department or <br />other parties responsible for implementing each measure and documenting <br />that each measure has been correctly implemented. <br /> <br />The proposed procedures for implementing the Mitigation Monitoring and <br />Reporting Program are: <br /> <br />4.1 Monitoring Procedures <br /> <br />An Environmental Monitor will be responsible for reviewing the <br />project plans, demolition plans and activities, right-of-way <br />acquisition, residential and business relocation, construction <br />sites, and/or operations to ensure that the mitigation measures <br />are properly and completely accomplished during the <br />implementation of the project. <br /> <br />Written documentation that each mitigation measure in Table <br />1 is implemented. This documentation can be on a City of <br />Santa Ana mitigation monitoring checklist or any similar form <br />that clearly indicates the schedule for implementation, whether <br />the measure has been implemented, or in the case of measures <br />that are ongoing, that a process has been developed to ensure <br />continued implementation of the measure. For example, the <br />mitigation measures related to the construction period traffic <br />controls are short-term and would be implemented and in place <br />until the completion of each phase of the project. On the other <br />hand, the redevelopment of remnant parcels not used for <br />roadway purposes would be ongoing and would require a <br />commitment on the part of the City to facilitate productive <br />reuse of the land through the exercise of its redevelopment <br /> <br /> <br />
