Marshall <br />Ordinance <br /> <br />This being the date set for the continued hearing on Amendment Application No. 366, i <br />filed by A. L. Marshall, amending Sectional District Map 2-5-9, to reclassify fro~ <br />A-1 District to the R-1 or R-3 District, property on the north end of Deodar Street~ <br />north of 17th Street, all as shown on Exhibits A.A. 366A and A.A. 3663, com~Aanica- <br />tion was presented frum the Planning Department, dated January 16, 1962, stating <br />the Planning Department has prepared a study concerning the use of the property and <br />possible street arrangements in the area bounded by Santa Clara Avenue, Tustin Free~ <br />way, 17th Street and Tustin Avenue. Attorney Milford W. Dahl, 401 West Eighth <br />Street, representing the applicant, stated the hearing had been postponed to obtain <br />further studies from the Planning Department, which have now been made, and pointedl <br />out diagrams prepared by the Planning Department showing the existing condition. <br /> <br />Mr. Dahl further stated the street limitation deprives this property of access; <br />pointed out a large garden type apartment to the west, and stated although the Appl%- <br />cation was for R-3, it was filed before the R-4 was available and it is the R-g in <br />which they are interested. Mr. Dahl stated he would like to retract his statement <br />m~de at the December 18th meeting that they would stand or fall on the R-3 Zoning <br />and now submit the R-1 if not the R-~ District. Approximately 30 people stood in <br />opposition to Amendment Application No. 366. Arthur Cooper, 13751 Deodar Street, <br />stated he opposed any zoning that would bring apartments into this area, a petition. <br />had been presented at the December 18th meeting that set forth the basic arguments <br />against multiple zening, the R-1 Zoning would bring a fair profit for the owners, <br />and further requested the City Council to accept the Resolution of the Planning <br />Com~ission as it reflects the interests of the residents in the co~mmnity. Mr. <br /> <br />Dahl stated this property has been owned by these people for g3 years and he does <br />not believe they purchased the property as a speculation, and the property is hem- <br />med on the east by the Freeway and on the west by an R-g development. Eugene B. <br />Erbentraut, 13911 Deodar Street, stated the amount of traffic which will cross <br />Deodar Street should be taken into consideration as there will be off-ramps at Chap- <br />man Avenue, First Street and 17th Street, but 100 percent of the traffic into Sant~ <br />Ana will flow across Deodar Street at 17th Street. Councilman Heinly stated he <br />wanted to review the zoning of the property on the west where the R-3 apartments <br />are located and advised seven notices were posted surrounding the property, not <br />less. than 300 feet from the property, and a notice of public, hearing was published <br />in the newspaper; at the hearing there were no protests on the rezoning of that <br />property. Mrs. Esther Cooper, 13751 Deodar Street, and pamala Day, 13852 Deodar <br />Street, stated no one had seen the notices regarding the rezoning of the property <br />to the west of the subject property as they were posted in an orchard. It was <br />moved by Councilman Brewer that the property on the north end of Deodar Street, nort~ <br />of 17th Street, be reclassified frem the A-1 District to the R-1 District, as shown <br />on Exhibit A.A. 3663, Amendment Application No. 366, filed by A. L. Marshall. <br /> <br />Motion lost for lack of a second. Warren Smith, 13912 Deodar Street, stated there <br />is a matter of ingress and egress, if this property becemes income property it wil~ <br />increase the traffic through a residential section, and though we are not opposed <br />to income property, we are opposed to heavy traffic on a residential street. <br /> <br />It was moved by Councilman Brewer and seconded by Heinly that the following 0rdi- <br />nance entitled: <br /> <br /> <br />
