<br />The Council having unanimously waived the reading of the Ordinance, on motion of
<br />Councilman Hubbard, seconded by Heinly and carried, the following Ordinance en-
<br />titled:

<br />District, property on the north side of Memory Lane, adjacent to the Spurgeon Meth-
<br />odist Church and almost directly opposite the north prolongation of Westwood Street~
<br />was considered and passed by the following vote:

<br />from the Planning Department rec~mnending approval of Preliminary Record of Survey ~
<br />253, filed by Ralph D. Mitzel~ dividing a parcel located on the west side of Berry-
<br />dale Street approximately 260 feet south of 17th Street, subject to conditions.
<br />Ralph D. Mitzel, 1023 North Baker, stated he purchased this property in one piece.
<br />On motion of Councilman Hubbard, seconded by Schlueter and carried, Preliminary Re-
<br />cord of Survey 253, filed by Ralph D. Mitzel, was approved subject to all condition~
<br />except the condition for the improvement of Berrydale Street, and the conditions to
<br />apply to the separate parcels individually.

<br />Communication was presented fr~n the Planning Department recc~mnending approval of ~
<br />Revised Tentative Tract 4528, filed by the Tustin Land Company, creating 37 lots
<br />located on the south side of Santa Clara Avenue between Lincoln and Grand Avenues,
<br />subject to conditions. John Siegel, Civil Engineer, 720 West First Street, Tustin,
<br />representing the applicant~ referred to Condition "d" and requested an option to
<br />drain across another lot in the subdivision, Lot 29, through the existing drainage
<br />facility under the Atchison, Topeka and Santa Fe Railway tracks to Lincoln Avenue.~
<br />Also, this area is within Drainage Area No. II~ and regarding the drainage on Santa
<br />Clara Avenue, part of the facilities at the railway tracks may be of value to the
<br />District, and questioned whether the applicant would be able to have credit applie~
<br />on the drainage fee for the drainage work that would be done within the subdivision~
<br />because, due to grades, it is necessary for the applicant to pick up the drainage
<br />coming down Santa Clara Avenue. On motion of Councilman Heinly, seconded by Brewer
<br />and carried, Revised Tentative Tract 4528, filed by Tustin Land Company, was appro~-
<br />ed~ subject tO conditions, with the option for the applicant to drain across Lot
<br />
<br /> 29 through the existing culvert under the Atchison, Topeka & Santa Fe Railway
<br /> tracks to Lincoln Avenue.
