Joseph W. Trumpy~ 1121 Memory Lane, employee of Mrs. Vose, spoke in favor of <br />the appeal, stating that a service station is the logical use of the land. There <br />being no further testimony, the hearing was closed. <br /> <br />On motion of Councilman Harvey, seconded by Councilman Schlueter, the City <br />Council overruled the decision of the Planning Commission and instructed the City <br />Attorney to prepare a resolution of findings and decision to grant Variance <br />Application 1826o After discussion, an amendment to the motion was proposed <br />by Councilman Hubbard to refer the matter back to the Planning Commission for <br />reccm=aended conditions to be attached to the granting of the variance. Council- <br />man Harvey and Schlueter agreed to the amendment and the amended motion was <br />carried "to overrule the decision of the Planning Commission and refer the matter <br />back to the Planning Commission for recommended conditions to be attached to the <br />granting of Variance Application 1826". <br /> <br />HEARING Mayor Hall opened the hearing on Appeal <br />APPEAL 96 - Application 96 filed by Paul Quong <br />QUONG from the Planning Commission's denial <br /> of Variance 1824 to construct two single <br />story triplexes at 833 N. Baker, R i District. The Clerk reported that notice <br />of the hearing was given by the Planning Department as required by law, and that <br />no written communications or objections had been received. <br /> <br />Robert F. Waldron, attorney for the applicant, cited exceptional circumstances <br />and conditions of the property because of its size and shape, restricting its <br />utilization in the R i zone over other properties in the neighborhood; that <br />proposed development would enhance the neighborhood; and that other variances <br />have been granted in the same zone in the same vicinity. Mr. Waldron presented <br />photographs to support his statements. <br /> <br />Ro G. Tremara, 832 Westwood, stated that neighbors would not object so strenuously <br />if duplexes were proposed. Lewis B. Jones, 1143 W. 10th Street, objected to <br />the proposal, noting it would create additional traffic congestion. There being <br />no further testimony, the hearing was closed. <br /> <br />On motion of Councilman Hubbard, seconded by Councilm~n Schlueter and carried, <br />the City Council upheld the decision of the Planning Commission and instructed <br />the City Attorney to prepare a resolution of findings and decision to deny <br />Variance Application 1824 without prejudice. <br /> <br />HEARING Mayor Hall opened the hearing on Appeal <br />APPEAL 97 - Application 97 filed by Willowick Golf <br />WILLOWICK GOLF C0)~RSE Course from the Planning Commission's <br /> approval of Variance 1822, Goeders and <br />Mark Hospital, Inc. to construct a thirty bed, one story convalescent hospital <br />for alcoholics at 3217 W. 5th Street. <br /> <br />The Clerk reported that notice of the hearing was given by the Planning Department <br />as required by law, and read a letter from Andrew R. Boersma, 3210 West 5th <br />Street, stating that he owned property within 300 feet of the subject propertY, <br />and that he had not been notified of the hearing held by the planning C~ission. <br /> <br />The Deputy City Attorney advised that since proper notice was lacking, the <br />proceedings should be declared null and void and the applicant should resubmit <br />his application. On motion of Councilman Hubbard, seconded by Councilm~n Schlueter <br />and carried, Council declared all proceedings null and void without prejudice to <br />the applicant, and instructed the applicant to reapply. <br /> <br />~HEARING <br /> AMEND.
